CM-1995-001LETTER OF UNDERSTANDING The recitals contained in this instrument are intended to provide objective data to assist the City of Round Rock in determining whether it would be advantageous for the City of Round Rock to enter into an agreement with the Travis County Constable's Department, Precinct 3, for the execution of warrants and collection of the associated fines, costs, and fees. In this Letter of Understanding, the City of Round Rock agrees, as a preliminary test, to provide the Travis County Constable's Department, Precinct 3 with a fixed number of warrants from its Municipal Court for execution and the collection of the associated fines, costs, and fees. The number of warrants to be provided to the Travis County Constable's Department, Precinct 3, shall be determined by the City of Round Rock. The term of t is Letter of Understanding shall commence on the q1 da oaL 1995, and shall terminate on the 7 -day of r .-M-LLa 199 The purpose of this preliminary test is to determine w ether the Travis County Constable's Department, Precinct 3, is able to timely, efficiently, and effectively execute the misdemeanor warrants issued by the Round Rock Municipal Court Judge for Class C and other misdemeanor offenses committed in the City of Round Rock, Texas. Upon receipt of these warrants, the Travis County Constable's Department, Precinct 3 shall use its best efforts to execute the warrants: 1) through the collection of fines, costs, and fees assessed by and owed to the Round Rock Municipal Court; or 2) by requiring the posting of appropriate bond(s), in an amount determined by the Round Rock Municipal Court Judge, ensuring the defendant's appearance in Round Rock Municipal Court. The City of Round Rock and the Travis County Constable's Department, Precinct 3 further agree that: 1. The Round Rock Municipal Court will provide a fixed number of warrants to the Travis County Constable's Department, Precinct 3. The warrants will be picked up from the Round Rock Municipal Court by an officer of the Travis County Constable's Department, Precinct 3. 2. The Travis County Constable's Department, Precinct 3, will use its best efforts to execute the warrants within the term of this Letter of Understanding. At the termination of this Letter of Understanding, the unexecuted warrants will be returned to the Round Rock Municipal Court. 3. During the term of this Letter of Understanding, the Travis County Constable's Department, Precinct 3 will provide daily reports that itemize all warrants executed or returned to the Round Rock Municipal Court, the manner in which the warrants were executed, the amount of fines, costs, and fees collected through the execution of these warrants, and shall return the executed warrants, copies of the warrant execution reports, and any fines, /1JC/(/) costs, and fees collected, or bond amounts received that are payable to the Round Rock Municipal Court. All fines, costs, and fees collected on warrants issued by the Round Rock Municipal Court will be itemized on the daily reports by warrant number and the defendant's name. 4. The Round Rock Municipal Court will allow the Travis County Constable's Department, Precinct 3 to retain the $35.00 warrant fee on each warrant when such fee is collected, and all fines, costs, and fees associated with the warrant are paid. No warrant fee will be retained, charged, or withheld for any unexecuted warrant. 5. The Travis County Constable's Department, Precinct 3 will provide a current list of designated contact personnel to the Round Rock Municipal Court for reference should any questions arise regarding the execution and payments associated with any warrant, or any other relevant questions. The Round Rock Municipal Court will provide to the Travis County Constable's Department, Precinct 3 a list of designated contact personnel regarding questions about any warrant, and with respect to City of Round Rock policies and procedures as may be related to the purposes of this Letter of Understanding. 6. The Travis County Constable's Department, Precinct 3 shall not accept partial payment for any warrants issued by the Round Rock Municipal Court. The acceptance of any partial payment alternative is within the discretion of the Round Rock Municipal Court Judge, and such discretion shall not be exercised by the Travis County Constable's Department, Precinct 3.
