Box 240730 San Antonio, Texas 78224 Re: At -Grade Public Road Crossing Improvement Agreement - CR 122 (Red Bud Lane), Round Rock, Texas Dear Mr. Garcia, In recognition of the possible time delays in execution of an At -Grade Public Road Crossing Improvement Agreement for the permanent railroad signals for the CR 122 (Red Bud Lane) crossing of the Union Pacific Railroad facility in Round Rock, this letter represents assurance that the City Staff will strongly recommend to the City Council to approve the reimbursement of all the actual costs incurred by Union Pacific Railroad for the city's project. The estimated costs of these improvements are $383,159.00. The City will present the formal At -Grade Public Road Crossing Improvement Agreement, subject to its availability, to the City Council at their next regularly scheduled meeting on February 22, 2007. I do not anticipate any problem with obtaining City Council approval. If you have any questions concerning the information above, please feel to contact Stephan Sheets, City Attorney, Thomas G.
