G-06-12-07-10C1 - 12/7/2006 ORDINANCE NA- D&-]0 -D7-J OC I AN ORDINANCE OF THE CITY OF ROUND ROCK, TEXAS ADOPTING THE 2006 EDITIONS OF THE INTERNATIONAL MECHANICAL CODE, INTERNATIONAL FUEL GAS CODE, INTERNATIONAL PLUMBING CODE, INTERNATIONAL ENERGY CONSERVATION CODE, INTERNATIONAL FIRE CODE, INTERNATIONAL BUILDING CODE, INTERNATIONAL EXISTING BUILDING CODE, AND INTERNATIONAL RESIDENTIAL CODE FOR ONE- AND TWO-FAMILY DWELLINGS, ESTABLISHING MINIMUM STANDARDS AND REGULATIONS IN THE CITY OF ROUND ROCK, TEXAS; AMENDING CERTAIN SECTIONS OF THE ADOPTED CODES; AND REPEALING ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. INTERNATIONAL MECHANICAL CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 edition of the International Mechanical Code (excluding only Appendix B) as published by the International Code Council, be and is hereby adopted as the Mechanical Code of the City of Round Rock for regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International @PFDesktop\::ODMA/WORLDOX/O:/WDOX/ORDINANC/O61121A1.WPD Mechanical Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes set forth below. B. Section 3 . 701 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.701 INTERNATIONAL MECHANICAL CODE (2006 EDITION) ADOPTED The 2006 edition of the International Mechanical Code (excluding only Appendix B) as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Mechanical Code of the City of Round Rock. Penalties, conditions and terms of said International Mechanical Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. C. Section 3 . 703 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.703 AMENDMENTS TO THE INTERNATIONAL MECHANICAL CODE (2006 EDITION) The International Mechanical Code is amended as follows: (a) Section 101.1. Inserted: City of Round Rock, Texas (b) Section 106.5.2. Inserted: "All fees for permits are governed by Section 3.105 of the Code of Ordinances, (1995 Edition) City of Round Rock." (c) Section 106.5.3. Deleted. (d) Section 108.4. Amended to read: "Violations of any provision of this Mechanical Code shall be punished by a fine of up to $2,000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense." (e) Section 108.5. Inserted: "Not less than $1.00 or more than $2,000.00." II. INTERNATIONAL FUEL GAS CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 edition of the International Fuel Gas Code (including Appendix A, Appendix B, Appendix C, and Appendix D) as published by the International Code Council, be and is hereby adopted as the Fuel 2 Gas Code of the City of Round Rock, Texas, for regulating and governing fuel gas systems and gas-fired appliances in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Fuel Gas Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes set forth below. B. Section 3 . 601 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.601 INTERNATIONAL FUEL GAS CODE (2006 EDITION) ADOPTED The 2006 edition of the International Fuel Gas Code (including Appendices A-D) as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Fuel Gas Code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Fuel Gas Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. C. Section 3 . 602 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.602 AMENDMENTS TO THE INTERNATIONAL FUEL GAS CODE (2006 EDITION) The International Fuel Gas Code is amended as follows: (a) Section 101.1. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round 3 Rock, Texas, said copy being marked and designated as the 2006 edition of the International Plumbing Code (including Appendix A, Appendix B, Appendix C, Appendix D, Appendix E, Appendix F, and Appendix G) as published by the International Code Council, be and is hereby adopted as the Plumbing Code of the City of Round Rock for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Plumbing Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, as set forth below. B. Section 3 . 501 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.501 INTERNATIONAL PLUMBING CODE (2006 EDITION) ADOPTED The 2006 edition of the International Plumbing Code (including Appendices A-G) as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Plumbing Code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Plumbing Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. C. Section 3 . 502 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.502 AMENDMENTS TO THE INTERNATIONAL PLUMBING CODE (2006 EDITION) The International Plumbing Code is amended as follows: (a) Section 101.1. Inserted: City of Round Rock, Texas 4 (b) Section 106.6.2. Inserted: "All fees for permits are governed by Section 3.105 of the Code of Ordinances, (1995 Edition) City of Round Rock." (c) Section 106.6.3. Deleted. (d) Section 108.4. Amended to read: "Violations of any provision of this International Plumbing Code shall be punished by a fine of up to $2,000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense." (e) Section 108.5. Inserted: "Not less than $1.00 or more than $2,000.00." (f) Section 305.6.1. Inserted: Twelve inches (12") (g) Section 904.1. Inserted: Twelve inches (12") IV. INTERNATIONAL ENERGY CONSERVATION CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 edition of the International Energy Conservation Code as published by the International Code Council, be and is hereby adopted as the Energy Conservation Code of the City of Round Rock for regulating and governing energy efficient building envelopes and installation of energy efficient mechanical, lighting and power systems in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Energy Conservation Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, as set forth below. B. Section 3 . 200 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.200 ENERGY CONSERVATION CODE 5 C. Section 3 . 201 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.201 INTERNATIONAL ENERGY CONSERVATION CODE (2006 EDITION) ADOPTED The 2006 edition of the International Energy Conservation Code as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Energy Conservation Code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Energy Conservation Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. D. Section 3 . 202 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.202 AMENDMENTS TO THE INTERNATIONAL ENERGY CONSERVATION CODE (2006 EDITION) The International Energy Conservation Code is amended as follows: (a) Section 101.1. Inserted: City of Round Rock, Texas V. INTERNATIONAL FIRE CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 edition of the International Fire Code (including Appendix A, Appendix B, Appendix C, Appendix D, Appendix E, Appendix F, and Appendix G) as published by the International Code Council, be and is hereby adopted as the Fire Code of the City of Round Rock, Texas, for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises in the City of Round Rock, 6 Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Fire Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, set forth below. B. Section 5 . 101 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 5.101 INTERNATIONAL FIRE CODE (2006 EDITION) ADOPTED The 2006 edition of the International Fire Code (including Appendices A-G) as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Fire Code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Fire Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. C. Section 5 . 102 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 5.102 AMENDMENTS TO THE INTERNATIONAL FIRE CODE (2006 EDITION) The International Fire Code is amended as follows: (a) Section 101.1. Inserted: City of Round Rock, Texas (b) Section 101.2.1. Amended to read: "Provisions in the appendices shall apply." (c) Section 107.5. Amended to read: "Correction and abatement of violations of this Fire Code shall be the responsibility of the owner and/or occupant." (d) Section 109.3. Amended to read: "Violations of any provision of this Fire Code shall be punished by a fine of up to $2,000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense." (e) Section 111.4. Inserted: "Not less than$1.00 or more than $2,000.00." (f) Section 506.1. Amended to read: " Where required. Where access to or within a structure or an area is restricted because of secured openings or where immediate access is necessary for life-saving or fire-fighting purposes, the fire code official is authorized to require a key box to be installed in an approved location. The key box shall be a Knox-Box® and shall contain keys to gain necessary access as required by the fire code official. A key box is required in all commercial occupancies that have an alarm system, sprinkler system, standpipe system, any type of fire suppression system, any commercial building over 5,000 square feet or any commercial structure over 1,000 square feet that has two or more businesses or suites, any commercial 7 business with an extraordinary hazard, and for any gated community or apartment complex." (g) Section 506.1.1. Amended to read: "Locks. An approved Knox® Padlock shall be installed on gates or similar barriers when required by the fire code official." (h) Section 508.5.1. Amended to read: "Where a portion of the facility or building hereafter constructed or moved into or within the jurisdiction is more than 300 feet from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains shall be provided where required by the fire code official." (i) Section 510.1. Amended to read: "Fire protection equipment shall be identified in an approved manner. Rooms containing controls for air-conditioning systems, sprinkler risers and valves, or other fire detection, suppression or control elements shall be identified for the use of the fire department. Approved signs required to identify fire protection equipment and equipment location, shall be constructed of durable materials, permanently installed and readily visible. Access to fire protection equipment shall be within 15 feet of an exterior door, or must have wall mounted post indicator valves accessible from the exterior of the structure." (j) Section 905.3.1. Amended to read: "Class I standpipe systems shall be installed throughout buildings where the floor level of the highest story is located more than 30 feet above the lowest level of the fire department vehicle access, or where the floor level of the lowest story is located more than 30 feet below the highest level of fire department vehicle access. Exceptions: 1. Class I standpipes are allowed in buildings equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1 or 903.3.1.2. 2. Class I manual standpipes are allowed in open parking garages where the highest floor is located not more than 150 feet (45 720 nun) above the lowest level of fire department vehicle access. 3. Class I manual dry standpipes are allowed in open parking garages that are subject to freezing temperatures, provided that the hose connections are located as required for Class II standpipes in accordance with Section 905.5. 4. Class I standpipes are allowed in basements equipped throughout with an automatic sprinkler system. 5. In determining the lowest level of fire department vehicle access, it shall not be required to consider: 5.1. Recessed loading docks for four vehicles or less, and 5.2. Conditions where topography makes access from the fire department vehicle to the building impractical or impossible." (k) Section 905.3.2. Amended to read: "Class I automatic wet standpipes shall be provided in Group A buildings having an occupant load exceeding 1,000 persons." 8 (1) Section 905.3.4.1. Amended to read: "The cabinet containing the hose connections shall contain a fire extinguisher per section 906 in place of fire hose." (m) Section 912.3.1. Amended to read: "Locking fire department connection caps. The fire code official is authorized to require locking caps on fire department connections for water-based fire protection systems where the responding fire department carries appropriate key wrenches for removal. Where required, Knox® FDC plugs or FDC Stortz Caps shall be installed." (n) Section 3204.3.1.1.Inserted: "Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited within the City of Round Rock city limits, with the exception of areas zoned for industrial use. Storage of flammable cryogenic fluids may be permitted at the discretion of the fire chief following his/her review of the proposed location and the fire protection for the storage area. Storage shall not be allowed within one hundred feet (100') of the property line of any Group E, I or R occupancies." (o) Section 3404.2.9.5.1. Inserted: "The storage of flammable or combustible liquids in outside above ground tanks is prohibited within each and every zoning district within the City of Round Rock, with the exception of those districts which are zoned for industrial use. Installation of above ground tanks in industrial districts shall be permitted at the discretion of the fire chief following his/her review of the proposed installation location and the fire protection for the storage area. When used in conjunction with Chapter 22, above ground storage will be allowed at the discretion of the fire chief. Tanks shall not be located within one hundred feet (100') of the property line of any Group E, I or R occupancies." (p) Section 3406.2.4.4. Inserted: "Storage of Class I and II liquids in above ground tanks is prohibited within the City of Round Rock city limits, with the exception of areas that are zoned for industrial use. Storage of Class I and II liquids may be permitted at the discretion of the fire chief following his/her review of the proposed location and the fire protection for the storage area. Storage shall not be allowed within one hundred feet (100') of the property line of any Group E, I or R occupancies. (q) Section 3804.2. Inserted: "Tanks shall not be located within one hundred feet (100') of the property line of any Group E, I or R occupancies." (r) Appendix D. Figure D103.1 dealing with cul-de-sac shall be amended to illustrate and read as follows: "100' DIAMETER CUL-DE- SAC." VI. INTERNATIONAL BUILDING CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 9 edition of the international Building Code (including all appendices) as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Round Rock for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Building Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes set forth below. B. Section 3 . 101 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 3.101 INTERNATIONAL BUILDING CODE (2006 EDITION) ADOPTED The 2006 edition of the International Building Code (including all appendices) as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Building Code of the City of Round Rock. Penalties, conditions and terms of said International Building Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. C. Section 3 . 102 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows : 10 3.102 AMENDMENTS TO THE INTERNATIONAL BUILDING CODE 2006 EDITION The International Building Code is amended as follows: (a) Section 101.1. Inserted: City of Round Rock, Texas (b) Section 3410.2. Inserted: January 1, 2007 VII. INTERNATIONAL EXISTING BUILDING CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 edition of the International Existing Building Code (including all appendices) as published by the International Code Council, be and is hereby adopted as the Existing Building Code of the City of Round Rock for regulating and governing the repair, alteration, change of occupancy, addition and relocation of existing buildings, including historic buildings, in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Existing Building Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes set forth below. B. Section 3 . 100 . 1 of the Code of Ordinances, (1995 Edition) City of Round Rock is added as follows : 3.100.1 EXISTING BUILDING CODE C. Penalties, conditions and terms of said International Existing Building Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. D. Section 3 . 100 . 1B of the Code of Ordinances, (1995 Edition) City of Round Rock is added as follows : 3.100.113 AMENDMENTS TO THE INTERNATIONAL EXISTING BUILDING CODE (2006 EDITION) The International Existing Building Code is amended as follows: (a) Section 101.1. Inserted: City of Round Rock, Texas (b) Section 1301.2. Inserted: January 1, 2007 VIII. INTERNATIONAL RESIDENTIAL CODE A. That a certain document, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, said copy being marked and designated as the 2006 edition of the International Residential Code for One- and Two- Family Dwellings (including all appendices) as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Round Rock for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one and two family dwellings and multiple single family dwellings (townhouses) not more than three stories in height with separate means of egress, in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International 12 Residential Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes set forth below. B. Section 3 . 103 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: 3.103 INTERNATIONAL RESIDENTIAL CODE FOR ONE- AND TWO-FAMILY DWELLINGS (2006 EDITION) ADOPTED The 2006 edition of the International Residential Code for One- and Two-Family Dwellings (including all appendices) as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the Residential Code of the City of Round Rock. Penalties, conditions and terms of said International Residential Code are hereby adopted and made a part hereof as if fully set out in this ordinance, except as amended hereafter. C. Section 3 . 103 . 1 of the Code of Ordinances, (1995 Edition) City of Round Rock is added as follows : 3.103.1 AMENDMENTS TO THE INTERNATIONAL RESIDENTIAL CODE (2006 EDITION) The International Residential Code is amended as follows: (a) Section RI01.1. Inserted: City of Round Rock, Texas IX. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. X. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Round Rock, Texas hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase 13 thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional . XI. The city secretary is hereby ordered and directed to cause this ordinance to be published for the requisite number of times in the appropriate newspaper of general circulation, and to cause this ordinance to be posted according to applicable requirements. XII. This ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from and after the date of its final passage and adoption. XIII. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance. shall not invalidate other sections or provisions thereof . C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this ordinance and the subject matter hereof were 14 discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
