AN ORDINANCE AMENDING THE CODE OF ORDINANCES (1995
EDITION), CITY OF ROUND ROCK, TEXAS, CHAPTER 1,
SECTION 1.1002.1(3) BY RENUMBERING SAME TO SECTION
1.002.1(4) AND AMENDING PARAGRAPH (b) RELATING TO
CIVIL SERVICE CLASSIFICATIONS AND AMENDING CHAPTER
1, SECTION 1.1002.1 BY ADDING NEW PROVISIONS
DESIGNATED AS SECTION 1 . 1002. 1(3) ENTITLED
"ESTABLISHMENT OF APPOINTED POSITION OF ASSISTANT
FIRE CHIEF;" AND PROVIDING FOR A SAVINGS CLAUSE; AND
REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS.
WHEREAS, the City of Round Rock has previously adopted
Chapter 143 , Texas Local Government Code, dealing with Municipal
Civil Service for firefighters; and
WHEREAS, Texas Local Government Code Section 143 . 014 (b)
provides as follows : "If approved by the governing body of the
municipality by resolution or ordinance, the head of a fire or
police department in the municipality in which at least four
classifications exist below the classification of department
head may appoint each person occupying an authorized position in
the classification immediately below that of department head, as
prescribed by this section. " ; and
WHEREAS, the City Council of the City of Round Rock desires
to create such an authorized position in the classification
immediately below that of department head, that being the
position of Assistant Fire Chief; and
WHEREAS, Texas Local Government Code Section 143 . 021 (a)
requires that the City' s governing body establish the
classifications of all firefighters and prescribe the numbers of
positions in each classification; and

WHEREAS, certain civil service classifications and numbers
of positions thereunder have changed: Now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS, THAT:
I.
The Code of Ordinances of the City of Round Rock, Texas, is
hereby amended by renumbering and amending Chapter 1, Section
1 . 1002 . 1 (3) as follows :
1.1002.1(4) Firefighters Civil Service Classifications and Numbers of Positions
(a) Chapter 143, Texas Local Government Code, dealing with Municipal Civil
Service for firefighters, was implemented effective October 30, 2001. Section
143.021(a) thereof requires that the City's governing body establish the
classifications of all firefighters and prescribe the numbers of positions in each
classification.
(b) The following civil service classifications are hereby established, and the
following numbers of positions in each classification are hereby prescribed:

II.
The Code of Ordinances of the City of Round Rock, Texas, is
hereby amended by adding the following provision to be designated
as paragraph (3) of Chapter 1, Section 1 . 1002 . 1 :
1.1002.1(3) Establishment of Appointed Position of Assistant Fire Chief
(a) The position of Assistant Fire Chief is hereby created.

(b) Such position shall be filled by appointment of the Fire Chief in accordance with
applicable subsections of Texas Local Government Code Section 143.014.
III.
A. All ordinances, parts of ordinances or resolutions in
conflict herewith are expressly repealed, including Resolution
No. R-01-09-13-15A1 establishing the position of Deputy Fire
Chief .
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof .
C. The City Council hereby finds and declares that written
notice of the date, hour place and subject of the meeting at
which this Ordinance was adopted was posted and that such meeting
was open to the public as required by law at all times during
which this Ordinance and the subject matter hereof were
discussed, considered and formally acted upon, all as required by
the Open Meetings Act, Chapter 551, Texas Government Code, as
amended.
Alternative 1 .
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

ITEM: 10.8.1. Consider an ordinance authorizing the creation of the position of
Assistant Fire Chief, and amending Chapter 1, Section 1.1002.1 of
the Round Rock Code Ordinance regarding firefighter civil service
classifications and number of positions. (First Reading)

Justification:
This ordinance will create the position of Assistant Fire Chief in accordance with Chapter
143.014(e) of the Texas Local Government Code and abolish the Deputy Fire Chief title. The
Assistant Fire Chief will perform the same duties as the Deputy Fire Chief with the same
salary range.
In addition, this ordinance will update the prescribed number of positions in each
classification effective with the approved changes in authorized positions. The FY 2006-2007
Operating Budget approved eight (8) additional firefighter positions to be added to existing
staffing levels with the opening of fire station #7. The fire department is adding one (1)
firefighter positions at this time and filling existing vacancies to lessen anticipated overtime
costs in February, March, April and May 2007 due to a number of FMLA Leaves by
firefighters for child birth. This ordinance increases the number of Captains by one (1) for
the Emergency Preparedness Coordinator's position. This position will be filled with the
current personnel strengths. This ordinance amendment reclassifies the number of
authorized sworn positions in the Round Rock Fire Department.
Funding•
Cost: $35,290.17 (firefighter classifications)
Funds are already allotted for Assistant Fire Chief through abolishment
of the Deputy Fire Chief
