("Engineer") ADDRESS: 1611 Chisholm Trail Road, Suite 250, Round Rock, TX 78681 PROJECT: FM 3406 — Sports Center Wastewater Line Improvements This Supplemental Contract No. 2 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Binkley & Barfield, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 27th day of April, 2015 for the FM 3406 — Sports Center Wastewater Line Improvements in the amount of $35,376.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on July 20, 2015 to amend the scope of services and to increase the compensation by $9,234.00 to a total of $44,610.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $8,593.00 to a total of $53,203.00; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum To Exhibit B. II. Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $8,593.00 the lump sum amount payable under the Contract for a total of $53,203.00, as shown by the attached Addendum to Exhibit D. Produce easement exhibits. Each exhibit will consist of separate metes & bounds descriptions for a permanent easement and a temporary construction easement, and a single survey drawing showing both easements (on multiple sheets if necessary), signed and sealed by a Texas Registered Professional Land Surveyor. The following easement exhibits are proposed: • 2 easement exhibits for the Sports Center Complex: One for the City property, and one for the adjacent property owned by American Freightways • 1 exhibit for the FM 3406 line for the property owned by Wood Glen Property Owners Association. 2. Preparation of Sewage Collection System (SCS) Application for submittal to the Texas Commission on Environmental Quality (TCEQ). Note: This includes preparation of the Geologic Assessment as required for the application (see attached proposal from PSI). B. Subconsultants tasks (and fees) shall be itemized when the subconsultant tasks reach $20,000 or 10% of the contract price whichever is greater. Details of task breakdowns inlcuding hours per person, and their full -loaded rate shall be provided to the PM for review and approval. Detail shall be maintained in the project file but NOT included in the contract documents or with Agenda packet. A separate task line or table may be used for cost plus services; however, only a loaded rate shall be shown. Group One (Peeslte) is developing the property located at 2800 Chisholm Trail, which is north of the existing Sports Center, west of Chisholm Trail and north of F.M. 3406. In a Memorandum of Understanding (MOU), the developer has agreed to pay the cost of the upsizing of an existing 10 -inch wastewater line (WWL) along FM 3406. This project will increase the final segment (manhole to manhole) of the 10 -inch WWL before it ties into the Onion Branch Regional Interceptor (approximately 350 If) to an 18 -inch WWL. The cost of the 10" to 18" upsize will be reimbursed by the Group One developer and is verified in the MOU. The City has become aware that the 10 -inch line is in conflict with the proposed TxDOT box culvert improvements and needs to be moved to the north. In order to do so, new easements are needed which requires additional surveying. Also included in this project is approximately 1,000 L.F. of 8 -inch WWL extending northeastly from the west side of the Sports Center across the FedEx property detention pond. This will provide wastewater service to the Group one parcel immediately to the north. The City Utility staff engaged the local engineering firm of Binkley & Barfield, Inc. to City of Round Rock Page 1 Printed on 8/28/2015 Agenda Item Summary Continued (CM -2015-888) perform the necessary design engineering, bid phase and minimal construction phase services. The City has asked Binkley & Barfield to survey and design the wastewater line to continue the collection main north to the Group One property. This Supplemental Agreement No. 2 covers the additional costs of easement surveys, design of a wastewater service to the FedEx property, and a Sewer Collection System (SCS) application to be submitted to TCEQ for approval. The cost for this additional work is $8,593, raising the previously amended contract amount of $44,610 to $53,203. The City Utility Staff recommends the City Manager to authorize execution of Supplemental Contract No. 2 with Binkley and Barfield, Inc. for the amount of $8,593.
