AN ORDINANCE VACATING, ABANDONING, AND CLOSING A
PORTION OF A 20 FOOT ALLEY IN THE WASHINGTON ANDERSON
ADDITION, WITHIN THE CITY OF ROUND ROCK, TEXAS, PURSUANT
TO SECTION 311.007, TEXAS TRANSPORTATION CODE, V.A.T.S.,
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING
CONFLICTING ORDINANCES AND RESOLUTIONS.
WHEREAS, Section 311.007, Transportation Code, V.A.T.S., allows a home-rule
municipality to vacate, abandon, or close a street or an alley; and
WHEREAS, the City of Round Rock desires to vacate, abandon, and close a
north-and-south public alleyway situated between Lots, 1, 2, 9 and 10, Block 1 of the
Washington Anderson Addition, an unrecorded subdivision in Williamson County,
Texas, as described in Exhibit "A" ; Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That a portion of the north-and-south public alleyway situated between Lots, 1, 2,
9 and 10, Block 1 of the Washington Anderson Addition, an unrecorded subdivision in
Williamson County, Texas, depicted in Exhibit "A," said exhibit attached hereto and
made a part of this ordinance, be hereby vacated, abandoned and closed, insofar as the
right, title, or easement of the public is concerned.
II.
That the abandonment provided herein shall extend only to the public right, title,
or easement in and to the tracts of land described in Paragraph I of this ordinance for
the purpose of using same as an alley, and shall be construed only to pertain to that

interest the governing body of the City of Round Rock may legally and lawfully abandon.
Nothing in this ordinance shall be construed to abandon or otherwise affect the interest
of the City of Round Rock or the public in easements within the subject area related to
public utilities, if any.
III.
A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
expressly repealed.
B. The invalidity of any section or provision of this ordinance shall not
invalidate other sections or provisions thereof.
C. The City Council hereby finds and declares that written notice of the date,
hour, place and subject of the meeting at which this Ordinance was adopted was posted
and that such meeting was open to the public as required by law at all times during
which this Ordinance and the subject matter hereof were discussed, considered and
formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

By motion duly made, seconded and passed with an affirmative vote of all the
Council members present, the requirement for reading this ordinance on two separate
days was dispensed with.

Memorandum of Understanding
Between
City of Round Rock
And
Gold Gals Holdings LLC
Whereas the Gold Gals Holdings LLC (GGH) desires to redevelop property located at 108 and
110 West Anderson 402 and 406 North Lampasas for commercial purposes as allowed by the
MU-2(Mixed Unit—2)Zoning District,and
Whereas the City of Round Rock desires to revitalize and enhance the northeast portion of
downtown Round Rock through the adoption of design standards which combine moderate
density residential development with moderate density commercial development. These design
standards require public improvements which are not completed at this time,and
Whereas the development schedule for the GGH is ahead of the City's development of the
desired public improvements,and
Whereas the GGH and the City desire to work together to facilitate the timely and orderly
development of the GGH property consistent with private and public design standards,
The following represents a general understanding of the work necessary:
A. The City will contract with a Civil Engineering Firm and successive General Contractor
to 1) provide an engineering design and 2) construct the water quality accommodations
(e.g. Storm Trooper)in a reasonable amount of time.
B. The City will waive all fees and related charges.
C. The City will waive payment for release of the alley (FYI, legally this could actually
mean paying$10.00 for the purchase,and keep in mind there is still the public process to
adhere to).
D. The City will allow GGH contribution(of water quality) into the Storm Trooper system.
(Note,application to TCEQ and approval is the responsibility of GJS.)
E. GGH will construct all public improvements to the City MU-2 District standard
(including sidewalks, on-street parking spaces, curb & gutter, and streetlights). Cite:

Both parties agree that Item A shall offset items B, C, D, and E, with no further moneys
changing hands. For further clarification the City is responsible for all costs associated with
items B, C and D, with the exception of the TCEQ application and approval which is at GGH
cost and the GGH is responsible for all the costs associated with item E.

Memorandum of Understandg
Between
City:of Round Rock
And
Gold Gals Holdings LLC
Whereas the Gold Gals Holdings LLC (GGH)desires to redevelop property located at 108 and
110 West Anderson 402 and 406 North Lampasas for commercial purposes as allowed by the
MLI-2(Mixed Unit 2)Zoning District,and
Whereas the City of Round Rock desires to revitalize; and enhance the northeast portion of
downtown Round Rock through the adoption of design standards which combine moderate
density residential development with moderate density commercial development. `hese design
standards require public improvements which are not completed at this time,and
Whereas the development schedule for the GGH is ahead of the ;,City's development of the
desired public improvements,and
Whereas the GGH and the City desire to work together to facilitate the timely and orderly
development of the GGH property consistent with private a .d public designstandards,
The following represents a general understanding of the work necessary:
A. The City will contract with a Civil Engineering Firm and successive General Contractor
to 1) provide an engineering design and 2) construct the water quality acro nedatiora;
(e. .Storm Trooper)ih a reasonable amount of time.
B. The City will waive all fees and related charges.
C, The City will waive payment for release of the alley (FYI, legally this could actually
mean paying$10.00 for the urchase,and keep in mind there is still the public process to
adhere to).
D. The City will allow GGII contribution (of water quality)into the Storm Trooper system.
(Note,application to TCEQ and approval is the responsibility of GDS.)
B, 0011 will construct all public improvements;, to the City li .7..2 District standard
(including sidewalks, on-sheet parking spaces, curb 8 gutter, and'streetlights). 'Cita:

Both parties agree that item. A shall offset items B, C, D, and B, with no further moneys
changing hands. For further clarification the City is responsible for all costs associated with
items B, C and,D, with the exception of the TCEQ application and approval which is at UGH
cost and the ' is responsible for all the costs associated with item E.
