That MARY KATHERINE LOERA, and their successors and assigns (hereinafter
referred to as "'Grantor"), for and in consideration as set out herein and other good and valuable
consideration by CITY OF IZC1IIND ROCK, TEAS, its agents, contractors, successors and
assigns, (hereinafter referred to as "Grantee"), the receipt and sufficiency of which is hereby
acknowledged, does hereby GRANT, SELL and CONVEY unto Grantee a Temporary
Construction Easement in and to the :Property described in Exhibit "A" attached hereto to
construct, install, connect, inspect, reconstruct, rebuild, and repair roadway improvements in the
adjacent right of way owned by Grantee, and any necessary accessories, grading, slope, or
operations thereto in connection with the Creek Fiend Blvd./Creels Fend Circle roadway
improvements by Grantee, across the :Property as necessary to carry out the purposes of this
Easement.
This conveyance is made and accepted subject to any and all conditions and restrictions,
if any, relating to the hereinabove described property, to the extent, and only to the extent, that
the same may still be in force and effect, shown. of record in the office of the County Clerk of
Williamson County, Texas.
Grantee shall have the right and privilege at any and all times to enter said premises, or
y part thereof, for the purpose of construction and maintenance of the improvements described
above, and all works all be performed in substantial conformance with the plans, notes, details
and specifications as shown in ]Exhibit "B" attached hereto and incorporated herein; all upon the
condition that upon completion of construction of the roadway improvements ° connections
referenced herein, Grantee shall repair and restore the surface of said premises as nearly as is
reasonably possible to the condition which the Property was in before the work. was undertaken.

This Temporary Construction ]Easement shall terminate and all rights in the Easement
area shall automatically revert to Grantor upon the expiration of twenty one (21.) days after the
first entry of Grantee upon the Property for the purposes of this Easement, or on July 31, 2016,
whichever occurs first.
Grantee hereby covenants and agrees:
(a) To the extent allowed by law, Grantee shall indemnify Grantor against any loss and
damage which shall be caused by the exercise of the rights of ingress and egress or by
any wrongful or negligent act oromission of Grantee's agents oremployees in the
course of their employment.
(b) At no time during the use of the Easement area shall Grantor be denied reasonable
access tot e remaining property for its existing uses.

As additional consideration for the granting of this Easement the Grantee agrees to
construct temporary fencing along the boundary of the Easement area at the request of owner,
which temporary fencing shall be removed upon completion of any work in the Easement area or
upon expiration of the rights granted herein.
TO HAVE AND TO HOLD the rights and interests described unto Grantee and its successors
and assigns, forever, and Grantor does hereby bind himself, his successors and assigns, and legal
representatives, to warrant and forever defend, all and singular, the above-described Temporary
Construction Easement and rights and interests unto Grantee, its successors and assigns, against
every person whomsoever lawfully claiming, or to claim same, or any part thereof.

Dear Ms. Loom
As you may be aware, the City of Round Rock ("City") is proposing to construct an
extension of Creek Bend Boulevard which is likely to begin in early 2015. The city's engineers
have determined that in order to assist with the construction of the roadway facilities and
sidewalk that the contractor will temporarily need to use a small portion of your property along
the front lot line.
Our law firm represents the City in its acquisition of property for roadway projects, and
we have been asked to contact you in order to secure the grant of this Temporary Construction
Easement. It is important to initially note that the City is not seeking to permanently take or
acquire any portion of your property. The temporary construction easement will just be used to
do some minor grading because the surface of the Creek Bend Blvd. and Creek Bend Circle
roadways will be getting higher in the area near your property in order to accommodate the
proposed bridge structure over Brushy Creek and Hairy Man Road.
I have enclosed a proposed Temporary Construction Easement ("TCE") document for
your review and execution, and I also wanted to add a few more points of explanation to help
you better understand the document and what it is intended to accomplish.
First, the area needed to be used is only 107 square feet in size along the front southeast
comer of your property, and is shown by a field note survey and plat labeled as Exhibit "A" to
TCE. The contractor will not be allowed to be on any other part of your yard outside of this area.
I have also enclosed a separate aerial exhibit which identifies the proposed TCE area for your
information as well. While we are not yet sure of the exact day when the contractor will need to
begin using the TCE area, once they do start using it they will only have twenty one days to
complete any of the necessary work, so your property will not be encumbered for a lengthy
period of time. So while we know the temporary use of your property will be an inconvenience,
we have worked with the engineers to keep the duration that they are on your property as brief as
possible.

When the contractor is ready to use the TCE area they can either a temporary fence along
the boundary of the area they will be using if you like, so that there will be a separation and
barrier for the rest of your yard while the contractor carries out the work. The proposed Creek
Bend Blvd./Creek Bend Circle construction work in the area of your property is shown in the
construction plans that are attached as Exhibit `B" to the TCE document. These are included to
show the design of the proposed project, but it is important to note that none of the proposed
roadway or sidewalk improvements are being constructed on your property. They are all being
built within the City owned right of way.
The next important thing to note is that this TCE area does not cover your driveway, and
you will not be denied access to or use of your driveway at any time during the construction
work. Also note that the general requirements in the plans, as well as the agreement in the TCE
document itself, provide that if any landscaping or vegetation is impacted that it will be replaced
or restored. This includes any grass, trees, irrigation, bushes, or other vegetation. So you can be
assured that your property will be restored to a condition as good or better as before the use of
the TCE area.
Lastly, as an additional incentive and consideration for granting this TCE the City will
pay you the sum of $250 in return for execution of the TCE document enclosed with this letter.
So please contact us as soon as possible to arrange for completion of the execution (we can
provide a notary if necessary) so that we can process your payment.
We also wanted to let you know that we can make ourselves available to meet with you at
your property with our engineers to better explain the proposed project and TCE uses `on the
ground" and go through any of the design plans in greater detail if you like. In the meantime,
