CM-2015-663 - 1/23/2015 17P 1 KK II I II II I� �II I I III II II �� ,� TEMPORARY CONSTRUCTION EASEMENT Creels Bend Blvd. THE STATE F TEXAS § § KNOW ALL BY THESE PRESENTS: COUNTY OF S That ALEXANDER COULTER and JESSE COULTER, and their successors and assigns (hereinafter referred to as "Grantor"), for and in consideration as set out herein and other good and valuable consideration by CITY OF ROUND ROCK, TEXAS, its agents, contractors, successors and assigns, (hereinafter referred to as "Grantee"), the receipt and sufficiency of which. is hereby acknowledged, does hereby GRANT, SELL and CONVEY unto Grantee a Temporary Construction. Easement in and to the ]Property described in Exhibit "A" attached hereto to construct, install, connect, inspect, reconstruct, rebuild, and repair roadway improvements in the adjacent right of way owned by Grantee, and any necessary accessories, grading, slope, or operations thereto in connection with.the Creek Bend Blvd./Creek Bend Circle roadway improvements by Grantee, across the ]Property as necessary to carry out the purposes of this Easement. This conveyance is made and accepted subject to any and all conditions and restrictions, if any, relating to the hereinabove described property, to the extent, and only to the extent, that the same may still be in. force and effect, shown of record in the office of the County Clerk of Williamson County, Texas. Grantee shall have the right and privilege at any and all times to enter said premises, or any part thereof, for the purpose of construction and maintenance of the improvements described above, and all work.. shall be performed in substantial conformance with the plans, notes, details and specifications as shown in Exhibit "B" attached hereto and incorporated herein.; all upon the condition that upon completion of construction of the roadway improvements and connections referenced herein, Grantee shall repair and restore the surface of said premises as nearly as is reasonably possible to the condition which the Property was in. before the work was undertaken given the uses of the Property, including repair or replacement of any landscaping, ornamental trees, irrigation, or other vegetative material. This Temporary Construction. Easement shall terminate and all rights in the Easement area shall automatically revert to Grantor upon the expiration of twenty one (21) days after the first entry of Grantee upon the Property for the purposes of this Easement, or on July 31, 2016, whichever occurs first. Grantee hereby covenants and agrees: (a) To the extent allowed by law, Grantee shall indemnify Grantor against any loss and damage which shall be caused by the exercise of the rights of ingress and egress or by y wrongful or negligent act oromission of Grantee's agents or employees in the course of their employment. ( ) At no time during the use of the Easement area shall Grantor be denied reasonable access to the remaining property for its existing uses. 00313903. )C As additional consideration for the granting of this Easement the Grantee agrees: (1) to construct temporary fencing or relocate the existing fencing along the boundary of the Easement area where any existing fencing is removed, to be maintained in place while any work is being done by Grantee in the Easement area; and (2) once the work within the Easement area is completed to reconstruct a permanent precast concrete fence on the existing right of way line prior to the completion of the proposed Creek Bend Blvd. construction project, of the type and according to the specifications as shown in Exhibit "C" attached hereto and incorporated herein. TO HAVE AND TO HOLD the rights and interests described unto Grantee and its successors and assigns, forever, and Grantor does hereby bind himself, his successors and assigns, and legal representatives, to warrant and forever defend, all and singular, the above-described Temporary Construction Easement and rights and interests unto Grantee, its successors and assigns, against every person whomsoever lawfully claiming, or to claim same, or any part thereof.
