In 2009 Williamson County entered into a Possession and Use Agreement with Nelson Homestead Family Partnership for right of
way required to widen FM 1460. As a part of that agreement Williamson County was obligated to pay for certain driveway
improvements on the Nelson property. Those obligations have been completed, and Nelson has now executed a deed for
transfer of the right of way to the City of Round Rock according to the project interlocal agreement.

NOTICE OF CONFIDENTIALITY RIGHTS: IF YOU ARE A NATURAL PERSON, YOU MAY
REMOVE OR STRIKE ANY OF THE FOLLOWING INFORMATION FROM THIS
INSTRUMENT BEFORE IT IS FILED FOR RECORD IN THE PUBLIC RECORDS: YOUR
SOCIAL SECURITY NUMBER OR YOUR DRIVER'S LICENSE NUMBER.
WHEREAS, Williamson County, Texas, the City of Round Rock, Texas, and the State of
Texas, acting by and through the Texas Transportation Commission, are authorized to purchase
and receive land and such other property rights deemed necessary or convenient for the
construction, expansion, enlargement, extension, improvement, or operation of a portion of the
proposed FM 1460 improvements ("Project"); and,
WHEREAS, the acquisition of the hereinafter -described premises has been deemed necessary
or convenient for the construction, expansion, enlargement, extension, improvement, or
operation of the Project;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
That Nelson Homestead Family Partnership, Ltd., a Texas Limited Partnership,
hereinafter referred to as Grantor, whether one or more, for and in consideration of the sum of
Ten Dollars ($10.00) and other good and valuable consideration to Grantor in hand paid by
Williamson County, Texas, receipt and sufficiency of which is hereby acknowledged, and for
which no lien is retained, either expressed or implied, have this day Sold and by these presents
do Grant, Bargain, Sell, Donate and Convey unto the City of Round Rock, Texas, all those
certain tracts or parcels of land lying and being situated in the County of Williamson, State of
Texas, along with any improvements thereon, being more particularly described as follows:
All of that certain 0.432 acre tract of land, more or less, being out of the Joseph Mott
Survey, Abstract No. 427, Williamson County, Texas; said tract being more particularly
described by metes and bounds in Exhibit "A" attached hereto and incorporated herein
(Parcel 109, p.2); and
All of that certain 1.068 acre tract of land, more or less, being out of the Abel Eaves
Survey, Abstract No. 215, and the Thomas Glasscock Survey, Abstract No. 255,
Williamson County, Texas; said tract being more particularly described by metes and
bounds in Exhibit "B" attached hereto and incorporated herein (Parcel 112)

RESERVATIONS FROM AND EXCEPTIONS TO CONVEYANCE AND WARRANTY:
Easements and rights-of-way of record; all presently recorded restrictions, reservations,
covenants, conditions, oil, gas or other mineral leases, mineral severances, and other
instruments, other than liens and conveyances, that affect the property; rights of adjoining
owners in any walls and fences situated on a common boundary; and any encroachments or
overlapping of improvements.
Grantor reserves all of the oil, gas and other minerals in and under the land herein conveyed but waives
all rights of ingress and egress to the surface thereof for the purpose of exploring, developing, mining or
drilling or pumping the same; provided, however, that operations for exploration or recovery of any such
minerals shall be permissible so long as all surface operations in connection therewith are located at a
point outside the acquired parcel and upon the condition that none of such operations shall be conducted
so near the surface of said land as to interfere with the intended use thereof or in any way interfere with,
jeopardize, or endanger the facilities of the Texas Department of Transportation or create a hazard to the
public users thereof; it being intended, however, that nothing in this reservation shall affect the title and
the rights of Grantee to take and use without additional compensation any, stone, earth, gravel, caliche,
iron ore, gravel or any other road building material upon, in and under said land for the construction and
maintenance of FM 1460, but shall not be used or exported from the Property for any other purpose.
Grantor is selling the Property to Grantee on an "as is" basis, and without any representations or
warranties other than the special warranty of title contained in this deed. Grantee agrees that it is
purchasing the Property based on its own studies and conclusions, and not based upon any
representations or warranties of Grantor or any agent of Grantor. Grantor specifically disclaims all
implied warranties concerning the Property, including the implied warranties of habitability,
merchantability, or fitness for a particular purpose. Further, Grantor makes no warranties regarding
endangered species or environmental conditions. Grantee acknowledges that this provision is a material
portion of the consideration for the donation and sale of the Property, and acknowledges that Grantor
would not agree to donate of sell the Property to Grantee on any other basis.
The payment of any taxes for the current or prior years due to a change in land use or ownership, and
any related penalty or interest, is hereby assumed by Grantee. Grantee acknowledges that this
conveyance has been made under the threat of condemnation.
TO HAVE AND TO HOLD the premises herein described and herein conveyed together with
all and singular the rights and appurtenances thereto in any wise belonging unto the City of
Round Rock, Texas and its assigns forever; and Grantors do hereby bind ourselves, our heirs,
executors, administrators, successors and assigns to Warrant and Forever Defend all and
singular the said premises herein conveyed unto the City of Round Rock, Texas and its assigns
against every person whomsoever lawfully claiming or to claim the same or any part thereof by,
through, or under Grantors, but not otherwise.
This deed is being delivered in lieu of condemnation.

boundary line of said 300.43 acre tract, and in part, the northerly boundary line of said 1629.95 acre tract,
S 69°02'31" W, passing at a distance of 1737.44 feet, a set 1/2" iron rod with TxDOT aluminum cap (to be

THENCE, departing said existing southerly right-of-way of C.R. 186, with the westerly boundary line of the

S 23°58'05" W for a distance of 57.38 feet to a calculated point, being the most westerly northwest
comer of the herein described tract, from which a found TxDOT Type I monument bears

of a curve to the right, 123.52 feet left of proposed F.M. 1460 baseline station 800+84.08;
2) Along said curve to the right, having a delta angle of 01°39'38", a radius of 2541.00 feet, an arc
length of 73.65 feet, and a chord which bears S 25°10'29" E for a distance of 73.65 feet to a set 1/2'
iron rod with TxDOT aluminum cap (to be replaced with TxDOT Type it monument after right-of-way
acquisition is complete), 128.87 feet left of proposed F.M. 1460 baseline P.C. station 801+57.53;
3) Continuing along said curve to the right, having a delta angle of 12°11'32", a radius of 2541.00 feet,
an arc length of 540.71 feet, and a chord which bears S 18°14'54" E for a distance of 539.69 feet, to
a set 1/2' iron rod with TxDOT aluminum cap (to be replaced with TxDOT Type 11 monument after
right-of-way acquisition is complete), in the existing easterly right-of-way Zine .of F.M. 1460, 143.01
feet left of proposed F.M. 1460 baseline station 806+77.35, being the most southerly corner of the
. herein described tract;
THENCE, with the westerly boundary line of the remaining portion of said 1629.95 acre tract, same being
said existing easterly right-of-way line of F.M. 1460, the following two (2) courses:
4) N.41°51'31" W for a distance of 8.16 feet to a calculated point, being an angle point in the westerly
boundary line of the herein described tract, from which a found TxDOT Type I monument bears
N 48°59'34' E, a distance of 1.05 feet;
5) N 21°00'20" W for a distance of 873.70 feet to the POINT OF BEGINNING, containing 0.432 acres
(18,823 square feet) of land, more or less.

of said 1629.95 acre tract, from which a found 1/2" iron rod with plastic cap bears S 71°14'21' W, a distance
of 0.21 feet;
THENCE, with the westerly boundary line of the remaining portion of said 1629.95 acre tract and the existing
easterly right-of-way line of F.M. 1460, N 21°09'07" W, passing at a distance of 508.51feet, a set 1/2" iron
rod with TxDOT aluminum cap (to be replaced with TxDOT Type II monument after right-of-way acquisition is
complete), 100.00 feet left of proposed F.M. 1460 baseline P.C. station 853+15.84, and passing at a

THENCE, departing said proposed easterly right-of-way line of F.M. 1460, continuing with the westerly
boundary line of the remaining portion of said 629.95 acre tract and said existing easterly right-of-way line of

of a curve to the left in the proposed easterly right-of-way line of F.M. 1460, 150.00 feet left of
proposed F.M. 1460 baseline station 817+68.95, being the most northerly comer of the herein
described tract;
THENCE, departing the existing easterly right -of way line of F.M. 1460, with said proposed easterly right-of-
way line of F.M. 1460, through the interior of the remaining portion of said 1629.95 acre tract, the following
three (3) courses:
6) Along said curve to the left, having a delta angle of 07°46'34", a radius of 3350.00 feet, an arc length
of 454.65 feet, and a chord which bears S 17°15'50" E for a distance of 454.30 feet to set 1/2" iron
rod with TxDOT aluminum cap (to be replaced with TxDOT Type 11 monument after right-of-way
acquisition is complete), 150.00 feet left of proposed F.M. 1460 baseline P.T. station 822+43.96;

proposed F.M. 1460 baseline station 826+12.90;
8) S 16°09'09" E for a distance of 573.73 feet to the POINT OF BEGINNING, containing 1.068 acres
