Justification:
This Supplemental Contract is for additional work required to start and successfully
complete the construction of the R.M. 1431 2.0 Million Gallon (MG) Elevated Water Storage
Tank. This work includes a Topographic Survey, a Karst Survey, and the Texas Commission
on Environmental Quality (TCEQ) project approval submittal and application fee.
Funding:
Cost: $10,000.00
Source of funds: Capital Project Funds (Self -Financed Utility)

Background Information:
This water line project, as well as two other water system improvement projects, are
required to deliver 4 Million Gallons Per Day of interim water to the City of Cedar Park by
the summer of 2009 (per an inter -local agreement). The other two projects are the RM
1431 36" Water Line project currently under construction by Cash Construction Company
and the 7.5 MGD High Service Pump at the City's Water Treatment Plant. In consideration
for the City completing these projects sooner than was planned, Cedar Park has paid Round
Rock a lump sum of $1,000,000, which was required upon awarding the construction
contract for this 36 -inch water line project.

This Supplemental Contract No. 1 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and HDR Engineering, Inc.,
hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 27th day of September, 2007 for the RM 1431 — 2 MG Elevated
Water Storage Tank Project in the amount of $324,523.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $10,000.00 to a total of $334,523.00; and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:

Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as set
forth in the attached Addendum To Exhibit C.

Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$10,000.00 the amount payable under the Contract for a total of $334,523.00, as
shown by the attached Addendum to Exhibit D.

ADDENDUM TO EXHIBIT B
Engineering Services
The changes to the scope of this project are as follows:
DESIGN PHASE
A. Topographic Surveying Scope of Work:
1. The Construction Plans developed under this contract will be tied to the City of Round
Rock's Horizontal and Vertical Control Network.
2. Construction staking of the pipe centerline will be the sole responsibility of the Construction
Contractor to pay for and execute the required surveying services. A scope of work, fees,
and performance schedule has been developed with Inland Geodetic to perform boundary
and topographic surveys for the elevated tank site located in the northeast corner of the park
along RM 1431. Inland will complete the work under a subconsultant agreement with the
Engineer.
3. Inland Geodetic will also perform the following field services after the site is cleared of cedar
and underbrush including: 1) Stake the center of the tank and protect (3 lathes and taping),
2) Stake corners of temporary construction area and protect (3 lathes and taping), and 3) Set
permanent pins at tank site property corners, stake location, and protect (3 lathes and taping).
The two western -most property corners which are within the temporary construction area
anticipated to be disturbed by construction activities will not be set as part of this work.
B. Karst Survey Scope of Work:
The scope of services to be provided as related to the pre -construction phase of the 1431
Elevated Tank Project is as follows:
The proposed project site is located on a 4 -acre tract in Round Rock, TX. This tract falls in Karst
Zone 2, an area defined as having a high probability of containing suitable habitat for the
following endangered karst invertebrate species:
• Tooth Cave ground Beetle (Rhadine persephone)
• Bone Cave Harvestmen (Texella reyesi)
• Coffin Cave Mold Beetle (Batrisodes texanus)
In addressing these endangered species issues there are three phases:
1) Karst Feature Survey
2) Habitat Evaluation of any features (may require excavation)
3) Endangered Species Surveys
The first phase, the karst feature survey, involves experienced personnel traversing the tract
while looking for caves or karst features. If no features are found, then no additional activities
are required.
If features are found, then a biologist will inspect the features to determine if suitable habitat for
endangered karst species exists. Excavation of the karst feature might be necessary for habitat
determinations. If no potential endangered species habitat is found, then no additional activities
are required.
If potential habitat is found, biologists with the necessary federal permits should then conduct
endangered species surveys, which require at least 3 visits. This proposal covers the first phase,
karst feature surveys, for the entire 4 -acre tract.
The Endangered Species Expert Biologist and Field Technician are the categories for our field
crew performing karst feature surveys. The Endangered Species Expert always holds a USFWS
permit for applicable karst invertebrates and meets USFWS recommendations for performing
presence/absence surveys. The Field Technician often holds a USFWS permit for karst
invertebrates, but may also be an experienced caver or geologist with training in karst feature
identification. Project management and work that demands an intimate knowledge of the
endangered species issues, such as meetings, report writing, consulting with USFWS, etc., is
performed by the Endangered Species Expert.
C. TCEQ Application Fee
1. An application fee of $3,000 is required by TCEQ in association with the Water Pollution
Abatement Plan. HDR shall submit a check for the above amount on behalf of the City;
and be reimbursed for this cost.
