SUBJECT: City Manager - April 25, 2008
ITEM: Action authorizing the City Manager to execute an Agent Authorization
Form required by the Texas Commission on Environmental Quality
(TCEQ) in conjunction with a request to exempt the Bagdad Avenue
Parking and Drive-Thru project from the Edwards Aquifer Recharge
Zone (EARZ) requirements.

Justification:
The Bagdad Avenue Parking and Drive-Thru project consists of removing the
existing parallel parking on the north side of Bagdad adjacent to the parking
garage, installing 45° -angle parking in the same location, and installing a new
water -billing drive-thru on the north side of Bagdad immediately west of Sheppard
Street. Because this activity is within the EARZ, the City must address State
requirements. The Agent Authorization Form is required for City Staff to submit an
application to the State.

Background Information:
All storm water runoff from the proposed construction site will flow in the street to
the east where it leaves the Edwards Aquifer Recharge Zone and enters the
Edwards Aquifer Transition Zone. In addition, the proposed project will be
increasing the impervious cover a very small amount in relation to the existing
impervious cover in the drainage basin. Because of these reasons, City Staff
recommends requesting an exception from the TECQ from the requirements to file
a Water Pollution Abatement Plan (WPAP) and providing post -construction water
quality measures for the project.

I James R.Nuse, PE, City Manager, of the City of Round Rock have authorized William J
Dobrowolski III, PE, CFM, of the City of Round Rock to represent and act on the behalf of the
above named Corporation, Partnership, or Entity for the purpose of preparing and submitting this
plan application to the Texas Commission on Environmental Quality (TCEQ) for the review and
approval consideration of regulated activities.
I also understand that:
1. The applicant is responsible for compliance with 30 Texas Administrative Code Chapter
213 and any condition of the TCEQ's approval letter. The TCEQ is authorized to assess
administrative penalties of up to $10,000 per day per violation.
2. For applicants who are not the property owner, but who have the right to control and
possess the property, additional authorization is required from the owner.
3. Application fees are due and payable at the time the application is submitted. The
application fee must be sent to the TCEQ cashier or to the appropriate regional office.
The application will not be considered until the correct fee is received by the commission.
4. A notarized copy of the Agent Authorization Form must be provided for the person
preparing the application, and this form must accompany the completed application.
