CM-08-06-179DATE: June 25, 2008 SUBJECT: City Manager - June 27, 2008 ITEM: Supplemental Agreement No. 1 to Planning Services Agreement for Consulting Services for Transportation Planning from The Goodman Corporation Department: Finance and Transportation Services Staff Person: Cindy Demers, Director of Finance Tom Word, Chief of Public Works Operations Justification: The City has identified an alternate location for the Downtown Intermodal Transit and Parking Facility. The alternate site requires a Phase I environmental assessment, a preliminary construction cost estimate, updates to the transit demand projections and Letter of No Prejudice and coordination with the Federal Transit Administration. Funding: Cost: $33,350.00 Source of funds: General Fund Outside Resources: The Goodman Corporation Capital Metropolitan Transit Authority Background Information: On February 14, 2008, City Council approved a resolution authorizing the Mayor to execute a Planning Services Agreement with The Goodman Corporation to develop and implement a Peak Hour Express Transit Service between Round Rock and the Capital Metropolitan Transit Authority (CMTA) service area. The original contract amount was $122,000. Implementation of a Peak Hour Express Transit Service is the next step in expanding transit services beyond the existing demand -response service. The express service will provide commuters and reverse commuters with connections between Round Rock and the CMTA Park and Ride at Tech Ridge during the morning and evening peak hour travel times. In addition to Municipal Office Complex and an interim park and ride in the vicinity of IH 35 and SH 45, the express service will provide service to employers located along Louis Henna Blvd/SH 45 and within the City limits. The Tech Ridge Park and Ride provides riders with access to the CMTA North Lamar/South Congress Route, the Dell Limited Route, the Braker Route and the Tech Ridge Express Route, as well as others. The City will continue to provide demand -response service within the City limits through the Capital Area Rural Transit System (CARTS). Public Comment: N/A CITY OF ROUND ROCK § THE STATE OF TEXAS § COUNTY OF WILLIAMSON § COUNTY OF TRAVIS § KNOW ALL BY THESE PRESENTS: SUPPLEMENTAL AGREEMENT NO. 1 TO "PLANNING SERVICES AGREEMENT" FOR CONSULTING SERVICES FOR TRANSPORTATION PLANNING FROM THE GOODMAN CORPORATION (TGC) FIRM: The Goodman Corporation (TGC) ADDRESS: 3200 Trasiis Street, Suite 200, Houston, Texas 77006-3654 This Supplemental Agree ent No. 1 to "Planning Services Agreement" is made by and between the City of Round Rock, Texs (hereinafter called the "City"), and The Goodman Corporation (hereinafter called "TGC"). WHEREAS, the City and TGC executed the referenced Agreement (hereinafter called the "Agreement") on the 14th day of the month of February, 2008; and WHEREAS, it has now become necessary to execute Supplemental Agreement No. 1 to provide a scope of services change to Exhibit "A" to the Agreement, such change delineating provision of additional planning services to support the City's Letter of No Prejudice amendment request to the Federal Transit Administration (FTA); and to add additional fees therefor to Exhibit "B" to the Agreement; NOW, 'THEREFORE, itemises considered, the City and TGC agree that said Agreement is amended as follows: I. A scope of services addition shall be made to Exhibit "A" entitled "Planning Services Agreement Scope of Services," by adding a section entitled "Task 7: Letter of No Prejudice Amendment Request, and said section shall read as follows: Task 7: Letter of No Prejudice Amendment Request 7.1 TGC will provide additional planning services to support the City's LONP amendment request to the FTA, said LONP amendment request being required due to the City's selection of a new preferred site for the Downtown Intermodal Transit Terminal and Parking facility, and due to the City's expansion of the overall facility development plan. Relative to the LQNP amendment request, TGC will do the following: • Perform analysis of new preferred site based on criteria used in the original site selection ranking. • Establish transit demand to justify parking space requirements. 00140436/jkg M- OLP-1l9 • Create new enviro� ental categorical exclusion based on new preferred site, to include a Phase I environmental assessment. • Develop preliminary construction cost estimates of the facility. • Respond to FTA questions or comments regarding LONP amendment request as needed. 7.2 Task 7 Deliverables. LONP amendment request; three (3) originals and one (1) electronic format copy to the City; and one (1) original submitted to FTA. II. An item shall be added to Exhibit "B" entitled "Planning Services Agreement Budget Schedule" as follows: Task Budget T7: LONP Amendment Request $33,350.00 Total $155,350.00 All services described in the attached exhibits shall be performed for the originally -contracted total sum of $122,000.00, with an added fee of $33,350.00 to be paid for the scope of services addition made in Supplemental Agreement No. 1. As a result the City received a LONP which allowed the City to incur costs of up to $7,146,490 related to transit/pedestrian streetscape improvements and the downtown intermodal transit faility. Recently, the City selected a new preferred site for the Downtown Intermodal Transit Terminal and Parking facility, in additioi to expanding the overall facility development plan. In order to protect the value of the new facility a LONP amendment request to the Federal Transit Administration (FTA) is required. Accordingly, TGC is pleased to provide additional planning services to support the City of Round Rock's LONP amendment request. Letter of No Prejudice Ameidment: The LONP amendment request to the FTA will include the following: • Analysis of the new preferred site based on criteria used in the original site selection ranking. • Establish transit demand to justify parking space requirements. • Create new environmental categorical exclusion based on new preferred site, to include a Phase I environmental assessment. • Develop preliminary construction cost estimates of the facility. TGC will respond to FTA questions or comments regarding LONP amendment request as needed. Deliverable: LONP amendment request; three (3) originals and one (1) electronic format copy for the City; and one (1) original submitted to FTA. Supplemental Planning Budget Schedule The total budget of Thirty Three Thousand Three Hundred Fifty Dollars ($33,350.00) inclusive of all fees and expenses shall be paid on a lump sum, percent of completion fee basis for the performance of the Scope of Services.
