Justification:
The property owner is requesting to release a portion of a 35' Drainage Easement
and a portion of a 35' Waterline and Wastewater line Easement.
The request is further described as a Partial Release of 8,237 square feet (0.19) of
two 35' easements, those being a Waterline Easement and Wastewater Line
Easement and a Drainage Easement recorded by separate instruments under
Document Numbers 2005068798 and 2005092576 and shown on the Palm Valley
Market Center Section 2 Final Plat, a subdivision recorded in Cabinet AA, Slides
315-317 of the Plat Records of Williamson Count, Texas.

Background Information:
All the appropriate utility providers have reviewed the proposal and have
concurred with the release request. The Legal Department has reviewed and
approved the request, and prepared the attached release document.

That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the Counties of
Travis and Williamson, State of Texas, for and in consideration of the sum of Ten and No/100 Dollars
($10.00) and other good and valuable consideration paid by BCRE Palm Valley LLC, the receipt and
sufficiency of which is hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE only
the below -described 8,237 square foot (0.19 acre) portion of two 35' easements, those being a Drainage
Easement under Document Number 2005092576 and a Waterline Easement and Wastewater Line Easement
under Document Number 2005068798, both appearing on that certain final plat recorded in Cabinet AA,
Slides 315-317, of the Plat Records of Williamson County, Texas, to -wit:
See Exhibit "A" descriptively labeled "Partial Release Drainage Easement" describing 8,237
square feet (0.19 acre) of land situated in the P.A. Holder Survey No. 9, Abstract No. 297 in
Williamson County Texas, being a portion of a called 37.975 acre tract of land as described in
Document No. 2006040139 and also being a portion of a 0.951 acre tract as described in
Document No. 2005092576 of the Official Records of said county, said 8,237 square feet
(0.19 acre) being more particularly described by metes and bounds as attached.
See Exhibit "B" descriptively labeled "Partial Release Water Line and Wastewater Line
Easement" describing 8,237 square feet (0.19 acre) of land situated in the P.A. Holder Survey
No. 9, Abstract No. 297 in Williamson County Texas, being a portion of a called 37.975 acre
