CM-08-09-234DATE: September 15, 2008 SUBJECT: City Manager Approval at the September 19, 2008 staff meeting ITEM: Consider executing Partial Release of Public Utility Easement located on Lot 1A, Block A, Amended Plat of the Replat of Lot 1, Block A, Oakmont Centre Section Seven and Replat of Lot 1, Oakmont Centre Section Four, also known as 301 University Blvd. Department: Planning and Community Development Staff Person: Justification: Jim Stendebach, Director of Planning and Community Development Lee Heckman, Principal Planner The property owner is requesting to release a portion of public utility easement (PUE) dedicated with the original plats. Adjacent, connecting 15' PUEs were dedicated with the original plats for Section Four and Section Sever. Abutting lots were subsequently combined and modified through the replatting and plat amending process. Consequently, lot lines have moved and the PUE is no longer anchored to a lot line; it has never been used for utilities. Although an amending plat of the property has recently been approved by the Planning and Zoning Commission, it cannot be recorded until this PUE has been released and a replacement dedicated. This substitute PUE will be dedicated along the new (proposed and approved) lot lines by separate dedication document. Funding: Cost: None Source of Funds: N/A Background Information: All the appropriate utility providers have reviewed the proposal and have concurred with the release request. The Legal Department has reviewed the request and prepared the attached release document.
