'l'h.at the City of Round Rock, a Texas hone -rule municipal corporation (hereinafter
called the "Declarant") has executed this Declaration of Right of Way for the purpose of
establishing the following road right of shay in, to, upon and across the following described
property in Williamson County, Texas, to -wit::
All of that certain 4.514 acre -tract of land, more or less, situated in the i ,%i.>lis
Donaho Survey, Ahstraet No. 173, Williamson County, Texas, and being more
particularly described by metes and. bounds in said Exhibit `:A" attached hereto
and incorporated herein,
The aforementioned described property is hereinafter referred to as the "Property".
The Property, rights, and privileges hereby designated shall be used for the purpose of
placing, constructing, repairing, widening and/or maintaining improvements to K.iphen Road Old
Settlers Boulevard and related drainage and other facilities. Except as otherwise stated, the
dcela ratio=n. and rights hereby created shall. be perpetual.
The benefits and obligations of the declaration created herein shall constitute benefits and
servitudes running with the land.
This Declaration. may be modified, amended or terminated by Deciar•ant.
