CM-08-10-258DECLARATION OF WATER LINE EASEMENT Colonial Grand at Ashton Oaks Project THE STATE OF TEXAS § KNOW ALL PERSONS BY THESE PRESENTS: COUNTY OF WILLIAMSON § That the City of Round Rock, a Texas home -rule municipal. corporation (hereinafter called the "Declarant") has executed this Declaration of Water Line Easement for the purpose of establishing the following exclusive easement in and under the following described property in Williamson County, Texas, to -wit: See Exhibit "A" describing a 0.136 acre (approximately 5,913 sq.ft.) tract of land, in the P.A. Holder Survey No. 297, Williamson Couny, Texas, being a portion of a 2.017 acre tract described in a Deed to the City of Round Rock, dated July 24, 1974, of record in Volume 592, Page 649 of the Deed Records of Williamson County, Texas; said 0.136 acres being more particularly described by metes and bounds as attached, and; See Exhibit "B" describing a 0.248 acre (approximately 10,804 sq.ft.) tract of land, in the P.A. Holder Survey No. 297, Williamson Couny, Texas, being a portion of a 9.976 acre tract described in a Deed to the City of Round Rock, dated January 19, 1999, of record in Document No. 9903347 of the Official Records of Williamson County, Texas; said 0.248 acres being more particularly described by metes and bounds as attached, and; See Exhibit "C" describing a 0.290 acre (approximately 12,615 sq.ft.) tract of land, in the P.A. Holder Survey No. 297, Williamson County, Texas, being a portion of a 11.223 acre tract described in a Special Warranty Deed to the City of Round Rock, dated August 20, 2007 of record in Document No. 2007071984 of the Official Records of Williamson County, Texas; said 0.290 acres being more particularly described by metes and bounds as attached, and; The aforementioned described property is hereinafter referred to as the "Easement". The Easement, rights, and privileges hereby created shall be used solely for the purpose of placing, constructing operating, repairing, maintaining, rebuilding, replacing, relocating, and removing a water line with all necessary conduits, casing, valves, manholes, ventilators and appurtenances. Except as otherwise stated, the Easement and other rights and privileges hereby created shall be perpetual. The benefits and obligations of the Easement created herein shall constitute benefits and servitudes running with the land. We (the City) are essentially dedicating the easement to ourselves.
