This instrument is given specifically to release the described portion of said easement, which portion of said easement is terminated by abandonment, termination, vacation, and cessation of purpose, and which portion of said easement will be of no further effect, whether legal or equitable. Department: Planning and Community Development Staff Person: Justification: Jim Stendebach, Director of Planning and Community Development Lee Heckman, Principal Planner The property owner is requesting to release a water line easement dedicated to the City by separate instrument. As part of a replatting process, it was determined that an existing gas line was not contained in an appropriate easement, but instead encroached into a water line easement. The City, through Engineering and Development Services, wishes to release the existing water line easement, and will be granted a new water line easement that accounts for a separate, newly dedicated, gas line easement. With the new gas line and water line easements, the current easement is no longer necessary and may be released. Funding: Cost: None Source of Funds: N/A Background Information: Engineering and Development Services have reviewed the proposal and have concurred with the release request. The Legal Department has reviewed and approved the request, and prepared the attached release document.
