At the meeting the regional customers approved revisions to the flow charges for fiscal year 2009 as shown in the attached Summary of Billable Flows and Flow Charges (Summary). Pursuant to section 5.02 of the Wastewater Disposal Contract, please confirm your agreement for the flow charges shown in the attached Summary by signing a copy of this letter in the space provided below and returning it to Monica Masters at: LCRA Water Services, P.O. Box 220 — H220, Austin, Texas 78767-0220. After receipt of your confirmation, LCRA staff will seek approval for these flow charges from the LCRA Board of Directors at its meeting on Wednesday, January 21, 2009. I also want to extend my appreciation for our discussion regarding proposals for metering the wastewater system or alternative methodologies for allocating flow charges for the system. While we have not reached resolution on these issues, I hope continued discussions will soon resolve these issues. In support of that, please send me information regarding the number of LUEs served by your respective wastewater system as of January 1, 2009. The Technical Review Committee will meet again on February 10, 2009, at 10:00 a.m. at the Brushy Creek Wastewater Treatment Plant Administration Building in Round Rock to review these LUE numbers and continue our discussions. Thane, P.E., Director of Utilities During a meeting on December 9, 2009 by the BCRWWS Technical Review Committee, the regional customers approved a revision to the customers flow charges for fiscal year 2009. This revision was required due to an adjustment to the method in which Fern Bluff Municipal Utility District (MUD) calculated their flow charges. This adjustment in flow charges results in an increase to the City of Round Rock's regional wastewater budget by $25,399. Upon receipt of this approval letter by all of the regional and sub -regional customers, the LCRA will seek approval by its Board of Directors on January 21, 2009. Funding: Cost: $25,399 Source of funds: Capital Project Funds (Self -Financed Utility) Outside Resources: Lower Colorado River Authority Regional and Sub -Regional Customers of BCRWWS Background Information: The LCRA owns and operates the Brushy Creek Regional Wastewater System. The system serves the following regional customers: City of Round Rock, City of Cedar Park, City of Austin, and the LCRA.
