§ MOW ALL BY THESE PRESENTS:
That the City of Round Rock, Texas, a Texas home -rule municipality, for and in
consideration of the sum of Ten and No/100 Dollars ($10.00) and other good and
valuable consideration paid to it by BONEHEAD PROPERTIES, LLC, a Texas limited
liability company, on behalf of itself and its successors and assigns, the receipt and
sufficiency of which is hereby acknowledged, does hereby ABANDON, RELEASE and
DISCHARGE an (Description of Size and Type) Easement dedicated by Plat recorded in
Cabinet F, Slide 203, Official Plat Records of Williamson County, Texas.
Such ABANDONMENT, RELEASE and DISCHARGE of the above -referenced
Easement shall apply only to the below -described property, to -wit:
A 24 FOOT ACCESS EASEMENT RECORDED IN CABINET F,
SLIDE 203 OF THE WILLIAMSON COUNTY OFFICIAL RECORDS,
LOCATED ON LOT 1A, RESUBDIVISION OF LOTS 1 & 2, KENNEY
FORT CENTER AS DESCRIBED IN EXHIBIT "A", ATTACHED
HERETO AND INCORPORATED HEREIN.
This instrument is given specifically to release the described original easement,
and to release such original easement only as to the property specifically described
herein, which easement is hereby terminated by abandomnent, termination, vacation, and
cessation of purpose, and which easement shall be of no further force and effect, whether
legal or equitable.
IN WITNESS WHEREOF, the City of Round Rock, Texas has caused this
instrument to be executed on this the (t-1: day of the month of May 2009.

Description of a 24 -foot Access Easement to be Released
Lot 1A, Resubdivision of Lots 1 & 2, Kenny Fort Subdivision
ALL OF THAT twelve (12) feet of a twenty-four (24) feet wide access easement on the
southeastern side of an approximate one -hundred ninety-six (196) feet common
northeast -southwest lot line of Lot 1A, Resubdivision of Lots 1 & 2, Kenny Fort
Subdivision, a subdivision as recorded in Cabinet F, Slide 203, and Lot 3, Kenny Fort
Subdivision, a subdivision as recorded in Cabinet D, Slide 268, said 12 feet to be
released being entirely on said Lot 1A;
TOGETHER WITH an entire twenty-four (24) feet wide access easement on the
southwest side of the southeast -northwest common lot line of said Lots in said
Subdivisions, said easement extending approximately thirty (30) feet southeast to
northwest and being entirely on said Lot 1A;
SAVE AND EXCEPT any portion of said 24 -feet wide access easements that are also
encumbered by a thirty (30) foot access easement, a five (5) foot public utility
easement, or a ten (10) foot public utility easement, said easements all dedicated with
the aforementioned Kenny Fort Subdivision; as shown on the attached sketch,
incorporated herein for all intents and purposes, and containing in total approximately
3072 square feet, more or less.

Justification:
The property owner is requesting to release a portion of an access easement
dedicated with the original plat, and carried forward with the replat. The access
easement is not used and is no longer needed.

Background Information:
Transportation Services concurs with the request to release the easement and the
City Attorney's office has reviewed the request and prepared the attached release
document.
