CM-09-06-121RECORDED DOCUMENT FOLLOWS iii 1011 iii 11 11 RELEASE AND TERMINATION OF TEMPORARY CONSTRUCTION EASEMENT THE STATE OF TEXAS COUNTY OF WILLIAMSON REL 7 PGS 02-23-09P02:41 RCVD KNOW ALL BY THESE PRESENTS: 2009010411 That the CITY OF ROUND ROCK, TEXAS a Texas home -rule municipality, for and in consideration of the sum of Ten and No/100 Dollars ($10.00) and other good and valuable consideration paid to it by WELLS FAR GO BANK, N.A., the owners of record of certain property more fully described herein, the receipt and sufficiency of which is hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE the below -described temporary construction easement dated on or about July 17, 2008, and recorded as Document No. 2008059367 of the Official Public records of Williamson County, Texas, to -wit: See Exhibit "A" attached hereto and made a part hereof, depicting a temporary construction easement area granted for the purpose of the construction of improvements and reconfiguration to the parking lot and driveway facilities of Wells Fargo and construction of other improvements in connection with the City's Hesters Crossing/I35 improvement project. This instrument is given specifically to release the described original temporary construction easement, and to release such described portion of said original temporary construction easement only as to the portion of the property specifically described herein, which portion is hereby terminated by abandonment, termination, vacation, and cessation of purpose, and which portion shall be of no further force and effect, whether legal or equitable. Department: Parks and Recreation Department Staff Person: Randy Gordon, Parks Manager Justification: The City is sponsoring the July 4th Fireworks Celebration at OId Settler's Park at Palm Valley on Saturday July 4th, 2009. As part of the celebration Sysco Austin Inc. shall provide a refrigerated trailer for watermelons for the event. The agreement is for delivering and picking up the trailer and for managing fuel during the time that it is in the park. Funding: Cost: Not applicable Source of funds: Not applicable Outside Resources: None Background Information: This is the 16th Annual July 4th Celebration that has drawn thousands of Round Rock citizens as well as other visitors to our area. OId Settlers Park at Palm Valley has provided an excellent location to host the Frontier Days activities as well as fireworks, watermelon, and vendors. This has contributed to making a memorable experience for citizens and visitors of Round Rock. Public Comment: UPDATED APRIL 2008
