CM-09-07-145Right of Entry Authorization
Permission is hereby granted for use of the Property for work which may include land surveying,
topographical, engineering, environmental, geotechnical studies and testing (including core drilling), and
appraisal, or other related tasks, and any other purposes described in the attached correspondence subject
to remuneration for physical damages actually done by City of Round Rock representatives. Damages
must be submitted in writing to the City within 30 calendar days of the date of occurrence.
The City of Round Rock agrees to indemnify and hold Owner harmless from any damages or other losses
to third parties resulting from any acts or omissions of the City, its employees, agents or assigns, in
carrying out the purposes of this right of entry on the Property.
This right of entry shall continue in effect for a period of two (2) years from the date of execution, unless
extended by owner in writing.

Notwithstanding any language to the contrary herein, if work by City causes alterations to the Property,
City shall restore the Property to as close as reasonably possible to its pre -alteration condition promptly
upon completion of the applicable portion of the work. To the extent allowed by applicable law, the City
of Round Rock expressly makes a waiver of any claim of sovereign or governmental immunity to the
extent that such claim or immunity may be asserted against the enforceability of this agreement.

Justification:
This resolution will approve Exhibit A to the Right of Entry Authorization allowing the City to
gain right of entry to a property owned by the Sonoma HOA for the Brushy Creek Regional
Trail Gap Project. Exhibit A was submitted by the Sonoma HOA and amended by City
Attorney.
Funding: $2,950,000.00

Background Information:
The City and Williamson County partnered on the project and received a $2.36 million grant
from CAMPO. The City is funding $190,000 and Williamson County is funding $400,000 of
this project. The project entails design and construction of approximately 2 miles of trail
connecting the existing Brushy Creek Trail to A.W. Grimes, as well as completing a trail gap
along the Lake Creek.
