4 AN ORDINANCE AMENDING CHAPTER 2, SECTION 2-326, CODE OF
5 ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING
6 AUTHORITY TO CONTRACT FOR EXPENDITURES; AND PROVIDING FOR A
7 SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND
8 RESOLUTIONS.

10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
11 TEXAS:
12 I.
13 That Chapter 2, Section 2-326, Code of Ordinances (2010 Edition), City of Round
14 Rock, Texas, is hereby amended to read as follows:
15 Sec. 2-326. General authority to contract for expenditures and approve certain change orders.

17 (a) General authority to contract for expenditures. Pursuant to section 4.01(f) of the City Charter, the city
18 manager is hereby authorized to execute contracts and/or to expend funds for budgeted items in the
19 maximum amount of $50,000.00, provided that all such contracts and expenditures are in
20 compliance with state laws requiring competitive bids. All contracts and/or expenditures in excess of
21 $50,000.00 must be approved in advance by the city council.

23 (b) Authority to contract for prior approved expenditures. Pursuant to section 4.01(f) of the City Charter,
24 the city manager is hereby authorized to execute contracts and/or to expend funds in the maximum
25 amount of$200,000.00 for items specifically approved in advance by the Council. The Council may
26 approve the aforesaid items in an exhibit attached to the annual budget or by resolution adopted by
27 the Council.
28 (bc) Contract change order. The city manager or his designee may approve change orders under the
29 following conditions:
30 (1) Any change involving a decrease or increase in cost of$50,000.00 or less; and
31 (2) Provided, however, that the original contract price may not be increased by more than 25
32 percent or decreased by more than 25 percent without the consent of the contractor to such
33 decrease.

37 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
38 expressly repealed.
39 B. The invalidity of any section or provision of this ordinance shall not
40 invalidate other sections or provisions thereof.

I C. The City Council hereby finds and declares that written notice of the date,
2 hour, place and subject of the meeting at which this Ordinance was adopted was posted
3 and that such meeting was open to the public as required by law at all times during
4 which this Ordinance and the subject matter hereof were discussed, considered and
5 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
6 Government Code, as amended.
7 Alternative 1.
8 By motion duly made, seconded and passed with an affirmative vote of all the
9 Council members present, the requirement for reading this ordinance on two separate
10 days was dispensed with.
