Round Rock intends to retain the engineering firm of Kimley-Horn and Associates, Inc. (the "Consultant") to conduct a traffic study to project the future traffic volumes in the missing s frontage road links as described in the Recitals and as shown in Exhibit "A", attached hereto and incorporated herein. 1.02. The services to be provided by the Consultant shall be as stated in the Scope of Work and Task Outlines shown on Exhibit"B", attached hereto and incorporated herein. s 1.03. Pflugerville agrees to share with Round Rock all costs paid to Consultant for the services provided pursuant to the terms described in this Agreement. The current total cost estimate is Twenty-Four Thousand Seven Hundred Thirty and No/100 Dollars ($24,730.00). 1.04 Pflugerville agrees to reimburse Round Rock the sum of Twelve Thousand Three ` Hundred Sixty-Five and 00/100 Dollars ($12,365.00) within ten (10) days after receipt of a z request for payment from Round Rock, including proof of payment to the Consultant. ARTICLE TWO GENERAL PROVISIONS t 2.01. Term of Agreement. This Agreement shall be for an initial term of one (1) year from the Effective Date. The Agreement will automatically renew and extend in the event all deliverables are not obtained from the Consultant by Round Rock and Pflugerville at the end of the initial term, until such time as all deliverables are received by both parties. Upon the mutual consent of both parties, the Agreement may be otherwise extended. i i F: 4 2.02. Authority. This Agreement is made pursuant to the authority conferred by V.T.C.A. Government Code, Chapter 791, and V.T.C.A. Local Government Code Secs. 402.001 and 402.017. h R 2.03. Payments From Current Revenues. All payments, if any, required to be made by a governmental entity hereunder shall be payable from current revenues or other funds lawfully available for such purpose. l 2.04. Entire Agreement. This Agreement contains the entire Agreement of the parties and supersedes all prior or contemporaneous, understandings and representations, whether oral or written, respecting the subject matter hereof. 2.05. Amendments. Any amendment hereof must be in writing and signed by the authorized representative of each party hereto. t 2.06. No Amendment of Other Agreements. Unless otherwise expressly stipulated herein, this t Agreement is separate from and shall not constitute an amendment or modification of any other agreement between the parties. 4 2.07. No Third Party Beneficiaries. The study will consist of an exhibit showing extension of the frontage roads, identify anticipated land-use, and document funding sources and agencies for the f' frontage road extension. ( Currently, there is a missing link in the frontage road for SH 45 in both the eastbound and westbound directions between Heatherwilde Blvd. and Arterial A. In the eastbound direction, the frontage road ends where the entrance ramp merges with SH 45 main lanes (just to the east of Arterial A). The frontage road resumes just to the east of the toll collection 3' booth,west of Heatherwilde Blvd. In the westbound direction,the frontage road ends just east of the toll collection booth t (west of Heatherwilde Blvd)and resumes at Donnell Dr. i No survey or utility coordination will be conducted as part of this project. Exhibits will be drawn on latest aerial imagery available. TASK OUTLINE s a I. PROJECT MANAGEMENT Project management spans the entire duration of the project and involves monitoring and coordination of services provided to the City to provide timely and efficient completion of the project. This task consists of project control and scheduling, documentation,reporting requirements,staff forums,meetings,and quality control. It is agreed for budgeting purposes that one kickoff meeting and one technical meeting will be held for the Project. Unless otherwise stated herein, it is assumed s that all Project review meetings will be held at the City of Round Rock Public Works Department offices. Y' II. DATA COLLECTION The Engineer will: 1. Coordinate with the City of Round Rock and City of Pflugerville to obtain existing and proposed land-uses, roadway networks and approved developments along SH 45 between Arterial A and SH 130, information on ? potential funding arrangements and agreements between different agencies for the roadway extensions. 2. Obtain from the City of Round Rock, City of Pflugerville, and TxDOT any existing plans or schematics for the frontage road extension. ( 3. (b) Lane geometry will match frontage road segments upstream of the project location. (c) Match curb and gutter section similar to existing frontage road. (d) Roadway profile,drainage features,ROW,parcel,and existing utilities information will not be shown. 2. Update land-use assumptions in the long range regional model to project 2020 traffic volumes on the missing frontage road links. 3. Redistribute existing peak-hour traffic volumes to the missing frontage road links by making reasonable assumptions. 4. Summarize the above findings and information in a technical memorandum. t 5.
