Cost: $48,540.00 Source of Funds: 2002 General Obligation Bonds SUPPLEMENTAL AGREEMENT NO. 3 TO "CITY OF ROUND ROCK AGREEMENT FOR ARCHITECTURAL SERVICES FOR 615 EAST PALM VALLEY CAMPUS PROJECT WITH KA HICKMAN ARCHITECTS & INTERIOR DESIGNERS" CITY OF ROUND ROCK STATE OF TEXAS COUNTY OF WILLIAMSON COUNTY OF TRAVIS KNOW ALL BY THESE PRESENTS: FIRM: KA Hickman Architects & Interior Designers ADDRESS: 1517 East Palm Valley Boulevard, Round Rock, Texas 78664 This Supplemental Agreement No. 3 to "City of Round Rock Agreement for Architectural Services for 615 East Palm Valley Campus Project with KA Hickman Architects & Interior Designers" is made by and between the City of Round Rock, Texas (hereinafter referred to as the "City"), and KA Hickman Architects & Interior Designers (hereinafter referred to as "KA Hickman"). WHEREAS, the City and KA Hickman executed the referenced Agreement (hereinafter referred to as the "Agreement") on the 12th day of the month of August, 2010 for provision of professional architectural services and interior design services related to the remodel of four existing City -owned buildings located at 615 East Palm Valley Boulevard in Round Rock, Texas; and WHEREAS, the City and KA Hickman also executed accompanying Supplemental Agreement No. 1 on the same date; and WHEREAS, the City and KA Hickman subsequently executed Supplemental Agreement No. 2 on the 7th day of January, 2011; and WHEREAS, it has now become necessary to execute Supplemental Agreement No. 3 to add new services to the Scope of Services, and to add new fees relating thereto: NOW, THEREFORE, premises considered, the City and KA Hickman agree that said Agreement is amended as follows: The Scope of Services shall be amended by addition of the following: KA Hickman shall be responsible for securing provision from Baker-Aicklen & Associates, Inc. of the following services: 213667/jkg OA- L PROJECT COORDINATION AND MEETINGS A. Coordinate with KA Hickman, the Owner, the Architect and other Project Design Consultants as required. B. Attend a maximum of four project coordination meetings during Design Phase. II. SITE PLAN ENGINEERING A. Site Plan Refinement 1. It is assumed that the only revisions to the site will be regrading and paving of the existing parking areas. No additional parking areas are proposed at this time. 2. Prepare and provide updated Site Plan for KA Hickman review and approval. B. Site Paving, Grading and Drainage Plans 1. Collect and review pertinent data. 2. Coordinate with KA Hickman and City staff. 3. Prepare Site Grading and Drainage Plan to include curb elevations, slopes, wall elevations (if any -- see note below), finished floor elevations, and details as necessary to depict needed stormwater improvements and any special drainage structures. The existing buildings and parking are programmed to remain, which means no increase in impervious cover is anticipated for this project. Therefore, site drainage detention and water quality ponds are not included herein; however, if needed, same can be provided as an additional service. Coordinate handicap accessible route with KA Hickman and the Architect. TDLR submittal and approval processing, for handicap accessibility, would be by KA Hickman or the Architect. Layout is to be based on the KA Hickman -approved Site Plan. 4. Include Site Grading and Drainage Plans, together with drainage calculations, in the Site Development Permit submittal. 5. Furnish KA Hickman AutoCAD file of City -approved documents. C. Erosion/Sedimentation, Tree Protection, Plans and Reports 1. Prepare a Temporary Erosion and Sedimentation Control Plan with appropriate details. 2 2. Prepare a Tree Protection Plan with appropriate details, if needed. 3. Use tree and topo survey drawings. 4. Prepare an Engineer's Report for the project, including necessary drainage analysis, site area calculations, vegetative description and Engineer's confirmation. 5. Submit the plans and Engineer's Report with the Site Development Permit application. 6. Prepare an SWPPP plan sheet and forms as required by the City. D. On -Site Water and Gravity Wastewater Service Plans 1. The existing buildings currently have utility service to them. No additional water or wastewater improvements are anticipated. E. Prepare and provide civil site work improvements technical specifications, with Construction Documents Phase, using City of Round Rock Standard Specifications. Notes: 1. Baker-Aicklen will not design structural walls higher than three (3) feet. The project Structural Engineer must prepare all necessary wall designs. 2. No drainage analysis for Onion Branch is included in this proposal; FEMA flows and floodplain information will be reflected on the drawings. SITE PLAN PERMITTING ASSISTANCE A. Prepare and submit application. B. Address all comments from the City concerning final drawings. Assist in obtaining permit approval. Note: City permit fee is to be paid by KA Hickman/Owner. IV. CONSTRUCTION PHASE SERVICES (LIMITED) A. Attend preconstruction conference. B. Visit construction site periodically. C. Interpret drawings and specifications. Review shop drawing submittals. 3 D. Observe construction for general conformity to contract documents (not full-time representation). Provide six (6) site visits during the civil site work portion of construction. Provide report for all site visits. E. Assist with final punch list (civil items only). F. Issue Engineer's concurrence letter for civil site work upon satisfactory completion by the Contractor. Note: Does not include plan revisions or site corrections that are not deemed engineering -related. V. RECORD DRAWINGS -- PROJECT CLOSEOUT A. Schedule and attend a required close-out meeting with the City. B. The Contractor shall provide Baker-Aicklen a fully marked -up set of record drawings showing changes made during construction. C. Baker-Aicklen will prepare a set of record drawing plans per the construction mark-ups and submit a set of mylars to the City. D. Provide the City a set of prints of the record drawings. VI. REIMBURSABLE EXPENSES A. All copying, purchases of maps and documents, tax certificates, deeds, printing of reports and plans, mailing, courier, express/overnight and other related expenses. Copies will be provided of any documents, as requested and as necessary to complete the work tasks. This estimate does not include governmental fees. VII. CLARIFICATIONS A. Any requested services not specifically covered by the above -listed will be provided on an actual time and materials expended basis in accordance with the Standard Rate Schedule. B. Construction staking is not included, as it will be required that the Contractor provide this work. C. All application and processing fees are the responsibility of KA Hickman/Owner. D. KA Hickman is to supply current Title Commitment or Policy. Additional research beyondwhat is included in the Title Commitment is not included. E. Resolution of conflicts is not included. 4 F. Any gap during the Site Work Engineering Design Phase of this project exceeding 30 calendar days as a result of KA Hickman's request to stop work may be considered reasonable cause to seek additional services. G. Coordination with the utility companies for the design and construction of electric, telephone and gas service will be provided by KA Hickman or the Architect's team. 1-1. The Site Plan can be considered finalized and in a position for full design to begin when the following data is received from the Architect and Mechanical/Electrical/Plumbing Engineer (unless an item is not included in the project): 1. Computer file of the site in AutoCAD with the final building footprint, general parking layout -- approved by the Fire Department for access. 2. Building coverage data 3. Building square footage by floors 4. Parking calculations 5. Roof drainage plan with downspouts 6. Accessible pedestrian route selected 7. Electrical transformer pad located and sized 8. Any project -specific areas that need civil consideration or that are impervious II. Section 1.1.2.5 of the Agreement shall be amended by addition of the following: The Fee Schedule relative to this Agreement shall show an increase for Professional Services in the amount of $48,540.00 (as delineated below) to the previous not -to -exceed amount of $380,087.00, for a new not -to -exceed total amount of $428,627.00, and such increase is in payment for the additional services added to the Scope of Services by this Supplemental Agreement No. 3.
