Dear Mr. Huggins:
As you are aware, the above referenced project has experienced unforeseen delays as a result of
public opposition. Accordingly, it is the City's position that the appropriate course of action at this
time is to suspend the engineering contract for this project.
In accordance with Article 10, entitled SUSPENSION, of the Contract for Engineering Services, the
City desires to exercise the right to suspend the contracted Engineering Services with Huggins/Seiler
& Associates, LP, but not to terminate the contract. Article 10 provides for a thirty (30) day period
before the suspension takes effect, which may be waived by mutual written consent of both parties.
If you are in agreement with waiving this 30 day period, please return a countersigned copy of this
letter to our offices within seven (7) days of receipt of this letter.
The City also acknowledges that some of the funds in the original contract which were allocated
towards plans, specifications and estimates were used for traffic studies associated with this project
at the City's direction. Accordingly, if this Engineering Services contract is reinstated in the future,
EXHIBIT B, entitled Engineering Services, and EXHIBIT D, entitled Fee Schedule, will require
modification to reflect this work and to provide funding to complete the design of this project.
All other requirements of the contract shall remain in effect and Article 3 entitled CONTRACT
TERM shall be extended for a time period equal to the suspension period.
