Re: Lease Agreement between the Greater Round Rock Community Foundation, Inc. as Landlord,
and the City of Round Rock, Texas, as Tenant, effective January 1, 2009
The term for the above referenced lease expired December 31, 2009. However, paragraph 15 "Holding
Over" allows for a tenancy at will relationship to exist after this date, should the Landlord see fit to allow
such.
This letter is to reciprocally acknowledge the stipulations outlined in paragraph 15 and affirm the
Landlord's intention to offer the Tenant the benefit of holding over. This relationship shall remain
subject to the will of the Landlord and in no way nullifies the right of the Landlord to terminate the
holding over allowance at any time.
It is the intention of the Greater Round Rock Community Foundation to allow the City of Round Rock to
continue use of the property until such time as necessary demolition or clearing or other activities to
prepare the property for development should commence. However, the Landlord in no way commits
that the use of property shall not be terminated before such time for any or no reason whatsoever.
All provisions of the lease shall remain in full force, and this "acknowledgement" is not intended to
revise, reduce, replace or broaden any stipulations in the executed lease referenced above.
However, the Tenant, by signing below, additionally agrees that notice of their wish to terminate the
relationship should be made known immediately in writing (by email or letter) to the Executive Director
of the Foundation. And further, the Tenant agrees to lock all entrances to property and all buildings on
the property and deliver keys to the Executive Director of the Foundation. Tenant agrees to send notice
upon the termination of the tenancy at will relationship to any previous users of the property (such as
any baseball leagues accustomed to use of the property) indicating that the fields are no longer available
for use.
