CM-11-08-163DECLARATION OF STAGE II MANDATORY WATER USE RESTRICTIONS Pursuant to authority granted to me in Sec. 44-225, Round Rock Code of Ordinances, and upon the recommendation of Michael Thane, Director of Utilities, I, Steve Norwood, Round Rock City Manager hereby declare that Stage II mandatory water use restrictions will be in effect in the City of Round Rock, as follows: 1. The date restrictions will begin is at 12:01 a.m. on Tuesday, August 16, 2011; 2. The circumstances that triggered the implementation of these mandatory restrictions are (i) the ongoing severe drought, (ii) the triple -digit temperatures and (iii) the dropping levels of Lake Georgetown. 3. The Stage II mandatory water use restrictions are set forth in Sec. 44-233(b) of the Round Rock Code of Ordinances and are summarized as follows: (i) All outdoor irrigation is prohibited unless it occurs in compliance with the twice -per -week watering schedule found in Sec. 44-233(a)(4); (ii) The washing of automobiles is prohibited unless it occurs in compliance with the twice -per -week watering schedule; (this does apply to commercial carwashes); (iii) The watering of ground around foundations is prohibited unless it occurs in compliance with the twice -per -week watering schedule; (iv) The refilling or adding of water to swimming or wading pools is prohibited unless it occurs in compliance with the twice -per -week watering schedule; (v) The operation of any ornamental fountain or other similar use of water is prohibited except where necessary to support aquatic life; (vi) The irrigation of golf fairways is prohibited unless it occurs in compliance with the twice -per -week watering schedule; (these restrictions do not apply to a golf course using wastewater effluent or private well water); (v) The following uses of water are prohibited: a. failing to repair leaking sprinklers, valves or faucets; b. washing sidewalks, driveways, parking areas, or other paved areas; c. operating irrigation system with broken heads, or heads out of adjustment that spray on streets or parking lots; and d. allowing any water to run off in the street or parking lot. 11-0%-tu3 4. Violations of the Stage II mandatory water use restrictions will have the following consequences: (i) An offense is a class C misdemeanor, punishable by a fine not to exceed $2,000 per violation; (ii) For repeat violations, water service may be disconnected or restricted; (iii) If a customer is irrigating during a prohibited time, a city worker may turn off the irrigation system if the worker cannot find a person at the address to turn off the irrigation system; (vi) The City may seek all injunctive or other civil relief available under the law.
