The CITY OF ROUND ROCK, TEXAS, its successors and assigns; hereinafter referred to as
Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other good and valuable
consideration to Grantor in hand paid by Hickerson Round Rock Land, LP, hereinafter referred to as
Grantee, receipt and sufficiency of which is hereby acknowledged, and for which no lien is retained,
either expressed or implied, have this day Sold and by these presents do Grant, Bargain, Sell and
Convey unto Grantee, its successors and assigns, all those certain tracts or parcels of land lying and
being situated in the County of Williamson, State of Texas, being more particularly described as
follows:
0.927 acres of land, more or less, as more particularly described by metes and bounds in
Exhibits "A" -"G", attached hereto and incorporated herein (the "Property")
RESERVATIONS FROM AND EXCEPTIONS TO CONVEYANCE AND WARRANTY:
Easements and rights-of-way of record; all presently recorded restrictions, reservations,
covenants, conditions, oil, gas or other mineral leases, mineral severances, and other instruments, other

than liens and conveyances, that affect the property; rights of adjoining owners in any walls and fences
situated on a common boundary; and any encroachments or overlapping of improvements.
Grantor expressly reserves unto Grantor and its assigns certain rights and interests in the nature
of a perpetual public utility easement and right-of-way in, upon, over, under, and across the Property.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used for the purposes
of location, placement, relocation, construction, operation, enlargement, maintenance, alteration, repair,
rebuilding, removal and patrol of public utilities, including, but not limited to, water lines, wastewater
lines, telecommunication lines, electric lines, sanitary sewer lines, connecting lines, access facilities and
related equipment, stormwater lines, drainage systems and structures, all necessary conduits, valves,
vaults, manholes, ventilators and appurtenances, storm sewers and collection facilities, drainage pipes
and all other related structures, and any necessary accessories, or operations.
Additionally, Grantor expressly reserves unto Grantor and its assigns an easement and right-of-
way to construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove materials for a slope easement, improvements and appurtenances thereto, in, upon, over, under,
and across the Property.
Grantor, for the consideration and subject to the Reservations from Conveyance and the
Exceptions to Conveyance, grants, sells, and conveys to Grantee the Property, together with all and
singular the rights and appurtenances thereto in any way belonging, to have and to hold it to Grantee and
Grantee's heirs, successors, and assigns forever, without express or implied warranty. All warranties
that might arise by common law as well as the warranties in section 5.023 of the Texas Property Code
(or its successor) are excluded.

THENCE, with the northerly line of said 10.30 -acre City of Round Rock Exhibit
"A" tract, being the southerly lines of said 0.99 -acre City of Round Rock Exhibit "C"
tract and said Lot 6, Block "A", Randall's Town Centre Section Two, the following two
(2) courses:
1) Along a curve to the left an arc distance of 260.32 feet, having a radius of
776.20 feet, and a chord which bears N7693146".W a distance of 259.10
feet to a concrete monument found for corner; and
2) N86°0379"W a distance of 103.50 feet to a %z" iron rod found at the most
southerly southwest corner of said Lot 6, Block "A", Randall's Town
Centre Section Two, at the intersection with the east right-of-way line of
Town Centre Drive, for the southwest comer of this tract;

N40°05'16"W a distance of 13.91 feet to a calculated point on the northerly line of said
0.99 -acre City of Round Rock Exhibit "C" tract, for the northwest comer of this tract;
THENCE, departing the east right-of-way line of said Town Centre Drive and
along the northerly line of said 0.99 -acre City of Round Rock Exhibit "C" tract, the
following two (2) courses:
1) S86°03'39"B a distance of 113.16 feet to a calculated point at a point of
curvature of a curve to the right; and
2) Along said curve to the right an arc distance of 255.45 feet, having a
