Right of Entry Authorization
This Right of Entry Authorization ("Right of Entry") is executed by and between Charles and Frances
Dumas (the "Owners") and the City of Round Rock, Texas, (the "City"). In consideration of the mutual
obligations recited herein, the sufficiency of which is hereby acknowledged, the Owners, being the
owners of approximately 15.11 acres and 9.8 acres of land as deeded to them in Document No.
199972826, Official Public Records, Williamson County, Texas (the "Property"), hereby grant the City
and its employees, contractors and agents permission to use the Property for work which may include
land surveying, topographical surveying, engineering, environmental, cultural artifacts, and geotechnical
studies and testing, including core drilling, and appraisal, or other related tasks (the "Work") subject to
the terms and conditions stated below:
1. This right of entry shall be limited to employees of the City and its contractors (the
"Contractors"), BWM Group, Waeltz & Prete Inc., Inland Geodetics, Fugro Consultants
Inc., and Horizon Environmental. All persons entering onto the Property pursuant to this
Right of Entry shall carry identification establishing that they are employees or agents of
the City or the Contractors. Any person not in possession of such identification shall not
be allowed onto the Property and shall be considered a trespasser.
2. Forty-eight hours prior to entering the Property pursuant to this Right of Entry, the City
or the Contractors shall notify the Owners via telephone at (512) 423-3108. The Owners
shall be permitted to accompany the City and the Contractors at all times.
3. The City and the Contractors shall only enter the Property through a gate located at the
southwest portion of the Property adjacent to Rabb Park.
4. Any clearing related to the Work shall be minimized to only that clearing necessary to
conduct the Work. All gates on the Property shall remain shut when not in use.
5. The City shall indemnify and hold the Owners harmless from all costs, claims, losses
and/or liens which may arise from the activities of the City or the Contractors on the
Property. To the extent practicable, the City shall return Property to substantially the
same or better condition that it was in before the Work. Damages must be submitted in
writing to the City within 30 calendar days of the date of occurrence. All trash, debris
and temporary markers shall be removed from the Property upon conclusion of the Work.
6. This Right of Entry shall continue in effect for a period of three (3) months from the date
of due execution by the Owners and the City, provided however, that the City may extend
this Right of Entry Authorization by a single one (1) month term by notifying the Owner
in writing fourteen (14) days prior to the expiration of this Right of Entry of the City's
intent to extend the Right of Entry.
7. The City and the Contractor shall limit their activities to that area shown in Exhibit "A"
designated as the "Right of Entry Corridor."
