TO CONTRACT FOR ENGINEERING SERVICES
FIRM: BROWN & GAY ENGINEERS, INC. ("Engineer")

PROJECT: Railroad Quiet Zone Study
This Supplemental Contract No. 4 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Brown & Gay Engineers, Inc.,
hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 22nd day of March, 2012 for the Railroad Quiet Zone Study Project
in the amount of $149,900.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on August 17, 2012
to amend the scope of services and to increase the compensation by $25,123.80 to a total of
$175,023.80; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on June 13, 2013 to
amend the scope of services and to increase the compensation by $141,700.51 to a total of
$316,724.31; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on June 26, 2014 to
amend the scope of services and to increase the compensation by $19,950.00 to a total of
$336,674.31; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $47,425.00 to a total of $384,099.31;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:

Article 2, Engineering Services and Exhibit B, En in�g Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.

Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$47,425.00 the lump sum amount payable under the Contract for a total of $384,099.31, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Contract in duplicate.

ADDENDUM TO EXHIBIT B
Engineering Services
Preface
The scope of services for this Supplemental Contract No. 4 shall be to continue to
provide professional services for the implementation phase of the railroad quiet zone
project in the City of Round Rock. These services shall include: project management,
scheduling and coordination efforts; additional agreements with the UPRR; updates to the
project plans due to additional requirements; and updates to the environmental documents
due to recent changes in the environmental checklists and process. The duration of the
project is being extended by approximately 18 months, as a result of delays incurred in
the Union Pacific Railroad's development of construction cost estimates. These
estimates were received by the City in August and November of 2015, approximately 17
months after the dates originally scheduled. The project still includes two separate quiet
zones: one for the main UPRR line at -grade crossings from CR 172 to Redbud Lane, and
one for the two at -grade crossings on the UPRR secondary line know as the "Georgetown
Industrial Lead" at IH -35. The Engineer will perform the following tasks:
A. Project Management and Scheduling
1. Revise the project schedule to reflect the extension of the project to approximately
August of 2017. The project schedule will be prepared with Suretrak or
Primavera P6 software.
2. Update the project schedule as needed or in a bi-monthly basis.
3. Coordinate the project with UPRR as needed, but at least on a monthly basis until
the construction agreements between UPRR and the City are signed. Coordinate
with UPRR on a bi-monthly basis after that. Coordinate with TxDOT and FRA as
needed, and assist the City in coordinating the project with Amtrak, LCRA and
the BNSF railroad.
4. Prepare monthly or bi-monthly reports as needed to document project progress.
B. Preliminary Engineering Agreements
1. Assist the City in the preparation of Preliminary Engineering Agreements with
UPRR for the following location:
o Brushy Creek Wastewater Treatment Plant
2. Prepare exhibits (Exhibit "A") for the location listed above.
3. Review responses from UPRR and provide feedback to the City.
4. Prepare a Notice of Intent (NOI) for LCRA and other possible stakeholders.

5. Update Quiet Zone Risk Index calculations as needed.
C. Prepare Environmental Documentation
The environmental documentation update will include separating the railroad quiet zone
project into two stand-alone c -list Categorical Exclusions (CEs). One CE will encompass
the two federally -funded crossings (at CR 172 and at St Williams Street), and one CE
will encompass the IH -35 at -grade railroad crossings. The scope of work will include
updating the February 2014 Blanket Categorical Exclusion (BCE) document previously
submitted as follows:
1. Prepare two Project Scope Development Tools and supporting documentation,
one for each project. Meet with Austin District to review the Project Scope
Development Tool, and confirm no regulatory agency coordination is required for
National Environmental Policy Act (NEPA) clearance of these projects (i.e.,
TPWD, USACE, THC, etc.)
2. Prepare two biological resources, hazardous materials and historic structures
Technical Forms and supporting documentation, one for each project. Submit
deliverables for TxDOT Austin District reviews and approvals. Based on the
scope of the project, no additional technical reports are required.
3. Address comments from TxDOT and prepare final documents. Scope includes
one round of revisions based on TxDOT documentation.
D. Prepare Design Plans
Update the design plans for roadway improvements and the installation of traffic
control devices as identified for each of the grade crossings listed below. The plans
will be on 11 x17 plan sheets in accordance with the City of Round Rock design
guidelines as well as TxDOT design standards for signing and signalization. The
following plans shall be prepared:
1. Brushy Creek Wastewater Treatment Plant
o Add median curbs and vertical delineator devices on each side of the
existing railroad crossing gates.
o Update the Pavement Markings and Signing Plan
2. Private Crossings
o Update the Signing Plans per latest standard provided by UPRR.
3. Revise the respective Quantity Summary Sheets for the above locations and the
overall project.
4. Revise Standard Drawings and Details for roadway work, signing, pavement
markings, and traffic control during construction, as needed.
5. Prepare miscellaneous exhibits as needed.
6. Revise the Bid Forms to reflect the changes outlined above, and to specify that
surveying work for fence installation will be the responsibility of the contractor.

Consider executing Supplemental Contract No. 4 with Brown & Gay Engineers, Inc. for
the Railroad Quiet Zone Study Project.
The original project was approved in March of 2012 and an analysis was conducted.
Brown and Gay put together a set of plans for the upgrades at the proposed crossings
from CR 172 to Red Bud Lane. Those plans were submitted to Union Pacific Railroad,
comments were addressed and plans were approved. The City received estimates
from Union Pacific for the Railroad work in December of 2015. The City is waiting on
final agreements from Union Pacific, once received those will be reviewed and
submitted to City Council for approval. After Council approval the actual work can be
scheduled.
The scope of services for this Supplemental Agreement No. 4 will continue to provide
professional services for the implementation phase of the railroad quiet zone project.
These services will include project management, updates to project plans due to
