On September 7 and 8, 2010, Brushy Creek experienced extraordinary flooding conditions that caused the
creek level to swell out of its banks and inundate a portion of the Brushy Creek Regional Wastewater System
(BCRWWS) - West Wastewater Treatment Plant. Since that time, the facility has been shut down, and the
wastewater flow has been diverted to the BCRWWS - East Wastewater Treatment Plant. This project will repair
the damages experienced from the flooding, as well as move equipment that was previously located in the
floodplain to a higher elevation.
The creation of the Public Utility Easement (PUE) establishes a dedicated route for dry utilities to cross the
West Wastewater Treatment Plant property site, without interfering with the infrastructure, while still providing
needed service to the plant site. Due to the relocation of equipment and buildings to a higher elevation,
overhead electric and telecommunication infrastructure must be installed in a proposed duct bank system
within the PUE.

That the City of Round Rock, Texas, a home -rule municipal corporation, the City of
Cedar Park, Texas, a home -rule municipal corporation, and the City of Austin, Texas, a home -
rule municipal corporation (hereinafter referred to collectively as the "Declarant") have executed
this Declaration of Public Utility Easement for the purpose of establishing the following
exclusive easement in, to, across and under the following described property in Williamson
County, Texas, to -wit:
Being a 0.210 acre (9,168 square foot) tract of land situated in the P.A. Holder
Survey, Abstract No. 297, in Williamson County, Texas, being a portion of that
8.12 acre tract of land conveyed to City of Austin, Texas, City of Cedar Park,
Texas, and City of Round Rock, Texas by instrument recorded in Document No.
2009089310 of the Official Public Records of Williamson County, Texas, and
being more particularly described by metes and bounds in Exhibit "A" attached
hereto and incorporated herein.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
for the purposes of location, placement, relocation, construction, operation, enlargement,
maintenance, alteration, repair, rebuilding, removal and patrol of public utilities, to -wit: electric
transmission and distribution lines, telecommunication and cable television lines, water lines,
natural gas lines, wastewater lines, sanitary sewer lines, connecting lines, access facilities and
related equipment, stormwater lines, drainage systems and structures, all necessary conduits,
valves, vaults, manholes, ventilators and appurtenances, storm sewers and collection facilities,
drainage pipes and all other subsurface drainage structures, and any necessary accessories, or
operations.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.
This Declaration may be modified, amended or terminated by Declarant.
