Section 36-46 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by a previously recorded plat. The plat was recorded in 1999. The lot contains a single family dwelling built in 2000. The applicant intends to build a swimming pool and patio, but the lot is constrained by two easements. There is a 10 -foot PUE along the east lot line, and a 15 -foot drainage easement along the south lot line. These easements and the location of the house restrict the buildable area. By vacating a 5 -foot portion of the PUE, there will be adequate area to locate the pool and patio in the backyard. There are no facilities in the 10 -foot PUE and all service providers have consented to the proposed vacation. No encroachment will be allowed in the 15 -foot drainage easement located along the south lot line because it contains an 8 -inch wastewater line. The applicant is not requesting any enroachment into that easement. Staff recommends approval of the easement vacation.
