This is an application to vacate a portion of a 15 -foot wastewater easement that crosses Lot
1, Block A of Randall's Town Centre, Section 3. Section 36-46 of the Subdivision
Ordinance allows a landowner to request the vacation of an easement established by a
separate instrument.
Instrument No. 2003059227 was recorded on June 25, 2003. The entire easement is
approximately 680 feet long and contains 10,274sf. This action will vacate 2,043sf of that
easement.
This lot contains thirty-two townhomes clustered in four buildings. An 8" wastewater line
was built within the easement, but subsequently abandoned and relocated with the
construction of the townhomes in 2006. On October 1, 2013, a replat of Lot 1 was
approved. Before the replat can be recorded, that portion of the easement that contains the
abandoned wastewater line must be vacated, and a new easement for the relocated
wastewater line must be recorded.
There are no facilities in this portion of the 15 -foot wastewater easement, and all service
providers have consented to the proposed vacation.

easement.
This lot contains thirty-two townhomes clustered in four buildings. An 8" wastewater line
was built within the easement, but subsequently abandoned and relocated with the
construction of the townhomes in 2006. On October 1, 2013, a replat of Lot 1 was
approved. Before the replat can be recorded, that portion of the easement that contains the
abandoned wastewater line must be vacated, and a new easement for the relocated

That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in
the Counties of Travis and Williamson, State of Texas, for and in consideration of the
sum of Ten and No/100 Dollars ($10.00) and other good and valuable consideration paid
by The Retreat Partners, LP, a Texas limited partnership, the receipt and sufficiency of
which is hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE
only the below -described portion of the easements of record in Document No.
2003059227 and Document No. 2002097728 of the Real Property Records of Williamson
County, Texas.
Being 2,043 square feet of land out of the Asa Thomas Survey, Abstract No. 609,
Williamson County Texas; being a portion of Lot 1, Block A, Randall's Town Centre,
Section 3, recorded in Cabinet BB, Slide 133 of the plat records of Williamson County,
Texas, as conveyed to the Retreat Partners, L.P. by special Warranty Deed recorded in
Document No. 2011017403 of the Official Public Records of Williamson County, Texas;
also being a portion of those Wastewater Easements as conveyed to the City of Round
Rock by instruments recorded in Document No.'s 2002097728 and 2003059227 of the

The purpose of this request is to release the above described easement or portion thereof to The Retreat
Partners, LP because the existing 8" wastewater main it contains was abandoned and filled with grout in
2006 with the construction of Knotting Hill Town Homes Phase I. After a thorough examination the
respective suppliers of utility service have no objection to this proposal and have indicated their
agreement by signing below. Thank you for considering this request.
