Section 36-46 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by a separate instrument. Instrument No. 2005033519 was recorded on May 5, 2005. The entire easement is approximately 180 feet long and contains 2,893sf. This action will vacate 40sf of that easement. This lot contains an auto dealership that was remodeled between 2006 and 2011. The encroachment occurred during the remodel, and was only recently noticed. This easement was dedicated for the installation of a fire hydrant and associated 6" waterline. There is approximately 4 feet of clear space between the building and the hydrant. Even with the partial vacation, the Fire Dept. will have adequate access to the hydrant. In addition, there will be adequate room to access the waterline for maintenance. There are no facilities in this portion of the 15 -foot waterline easement, and all service providers have consented to the proposed vacation. Staff recommends approval of the easement vacation.
