This is an application to vacate a portion of a 15 -foot waterline easement that crosses Lot 1, Block A
of the Replat of "Classic Addition" and "Crystal Park Lot 1 Block A, Amended". Section 36-46 of the
Subdivision Ordinance allows a landowner to request the vacation of an easement established by a
separate instrument. Instrument No. 2005033519 was recorded on May 5, 2005. The entire
easement is approximately 180 feet long and contains 2,893sf. This action will vacate 40sf of that
easement.
This lot contains an auto dealership that was remodeled between 2006 and 2011. The
encroachment occurred during the remodel, and was only recently noticed. This easement was
dedicated for the installation of a fire hydrant and associated 6" waterline. There is approximately 4
feet of clear space between the building and the hydrant. Even with the partial vacation, the Fire
Dept. will have adequate access to the hydrant. In addition, there will be adequate room to access
the waterline for maintenance.
There are no facilities in this portion of the 15 -foot waterline easement, and all service providers
have consented to the proposed vacation.
Staff recommends approval of the easement vacation.

That the City of Round Rock, Texas, for and in consideration of certain good and
valuable consideration paid by Classic Special Real Estate, Inc., the receipt and sufficiency of
which is hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE only the
below -described portion of that certain Waterline Easement ("Easement") of record in Document
Number 2005033519 of the Official Public Records of Williamson County, Texas.
Such ABANDONMENT, RELEASE and DISCHARGE of the above -referenced Easement shall
apply only to the below -described property, to -wit:
See Exhibit "A" attached hereto and made a part hereof, describing that certain
0.0008 of one acre tract of land, situated in the David Curry Survey, Abstract No.
130 in Williamson County, Texas.
This instrument is given specifically to release the described portion of said Easement,

Re: Partial release of 40 square feet of a 15 foot wide water easement that begins along the
North line of Lot 1, Block A of the Replat of "Classic Addition" and "Crystal Park Lot 1 Block A
Amended" otherwise known as 2301 N IH -35. (See attached exhibit)
Dear City Manager:
The purpose of this request is to release the above described easement or portion thereof to
eliminate the current encroachment of approximately 40 sf of the existing Toyota building within
existing water easement doc. #2005033519. After a thorough examination the respective
suppliers of utility service have no objection to this proposal and have indicated their agreement
by signing below.
