A copy of the plat for this property is atached. The property had a tax lien for failure to pay outstanding property taxes, and a tax suit was instituted and judgment in the amount of $978.86 was obtained against the owner. The property was offered to tax sale on 12/3/13, and Sheets & Crossfield entered a bid of $500 to acquire the property. This amount would pay the minimum tax owed and associated costs and fees, in return for which the City would receive a deed to the property By this memorandum, City staff requests approval of payment of the amount of $500.00 payable to Williamson County Constable as consideration for the property to be purchased at tax sale for use in the Creek Bend roadway project. Buyer assumes all risks as to condition of the property, location of property and title to the property. THERE IS NO WARRANTY OF TITLE. The sale may be cancelled at any time prior to the close of the sale at the discretion of the Round Rock Independent School District and/or City of Round Rock. All sales are subject to a right of redemption as specified by Section 34.21 of the Texas Tax Code. Because the owner of the property has the right to redeem (re -acquire) the property, care should be taken before incurring expenses related to the property until the redemption period expires. Some expenses may be recouped as part of the redemption price but others cannot be recovered. Because purchasers will receive a constable's deed without a warranty of title a policy of title insurance may be difficult to obtain. The constable's deed will convey the interest owned by the defendants to the property. If the underlying judgment did not include a person(s) who owns any type of interest including a lien then the property will be sold subject to any such interest. However, the property will be sold free and clear of all interests held by the defendants in the judgment. Any liens held by defendants in the judgment will be cut off. The bidder is advised to make an independent inquiry as to the title to the property. It is the responsibility of the bidder to determine the liabilities that may exist against the property. There may be ad valorem taxes, penalties and interest owed that accrued subsequent to the judgment under which the tax sale is being conducted and the property will be sold subject to those post judgment taxes, penalties and interest. Under the terms of Section 34.015, Texas Tax Code the constable conducting the sale may not execute a deed to the high bidder until the high bidder presents to the officer a written statement from the County Tax Assessor -Collector which states that the purchaser owes no delinquent taxes to this county or to any school district or city that is located fully or partially in this county. If a purchaser fails to produce such a written statement he will not receive a deed and he will not receive a refund of the purchase money paid. If you have any questions on the tax sale procedure or the rights, restrictions and obligations under a Constable's Tax Sale Deed you need to consult your own attorney. By submitting a bid, a bidder agrees to accept these conditions as well as all other conditions imposed by the applicable laws of the State of Texas whether or not this notice is signed.
