Section 36-46 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by a separate instrument or a previously recorded plat. The plat for the Behren's Ranch, Sec. 4 was recorded on August 19, 2008. The plat dedicated a 7.5 -foot wide PUE across Lot 21. The lot contains a single family dwelling built in 2013 that inadvertently encroaches 9.15 sf into the PUE. This is a request is to vacate that 9.15 sf portion of the PUE. All service providers have consented to the proposed vacation. Staff recommends approval.
