AW Grimes Blvd. Section 36-46 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by a separate instrument. The plat for the EMINLC Subdivision was recorded on September 6, 2007. The plat dedicated a 15 -foot wide wastewater easement across Lot 2. That lot was developed with several buildings that are being used as a self -storage business. When originally constructed, two of the buildings inadvertently encroached into the wastewater easement. The first building encroaches a total of 33 sf. The second building encroaches a total of 26 sf. This request is to vacate only those two portions of the easement that contain the encroachments. The remainder of the easement is unchanged. All service providers have consented to the proposed vacation. Staff recommends approval.
