This is an application to vacate two portions of a 15 -foot wastewater easement that crosses
Lot 2, Block A of EMINLC Subdivision, at 1515 S. AW Grimes Blvd. Section 36-46 of the
Subdivision Ordinance allows a landowner to request the vacation of an easement
established by a separate instrument.
The plat for the EMINLC Subdivision was recorded on September 6, 2007. The plat
dedicated a 15 -foot wide wastewater easement across Lot 2. That lot was developed with
several buildings that are being used as a self -storage business. When originally
constructed, two of the buildings inadvertently encroached into the wastewater easement.
The first building encroaches a total of 33 sf. The second building encroaches a total of 26
sf. This request is to vacate only those two portions of the easement that contain the
encroachments. The remainder of the easement is unchanged.
All service providers have consented to the proposed vacation.

That the City of Round Rock, Texas, for and in consideration of certain good and
valuable consideration paid by VLC Enterprises LLC d/b/a Assured Self Storage, the receipt and
sufficiency of which is hereby acknowledged, does hereby ABANDON, RELEASE and
DISCHARGE only the below -described portion of that certain Wastewater Easement dedicated
in Cabinet DD, Slides 306-307 of the Official Plat Records of Williamson County, Texas.
Such ABANDONMENT, RELEASE and DISCHARGE of the above -referenced Easement shall
apply only to the below -described property, to -wit:

See Exhibit "A" attached hereto and made a part hereof, describing that certain

EMI/VLC Subdivision, a subdivision recorded in Cabinet DD, Slides 306-307 of
the Plat Records of said county.
This instrument is given specifically to release the described portion of said Easement,
which portion of said easement is terminated by abandomnent, termination, vacation, and
cessation of purpose, and which portion of said Easement will be of no further effect, whether
legal or equitable.

Re: Proposed release of (2) approximate 2.4' x 15' portions of a waste water easement
Dear City Manager:
The purpose of this request is to release the above described easement or portion thereof to
exclude the southern portions of Assured Self Storage buildings "G" and "1", located at 1515
N. AW Grimes Blvd., due to incidental encroachment on the existing waste water easement
at the time of construction.
This is not a public utility easement, but only a waste water easement dedicated to the city of
Round Rock, therefore no other utility service's approval is required.

THE P.A. HOLDER SURVEY NO. 297, WILLIAMSON COUNTY, TEXAS,
BEING A PORTION OF LOT 2, BLOCK A, EMI/VLC SUBDIVISION, A
SUBDIVISION RECORDED IN CABINET DD, SLIDES 306-307 OF THE
PLAT RECORDS OF SAID COUNTY, SAID 0.001 ACRE TRACT, AS
SHOWN ON THE ACCOMPANYING SKETCH, BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING FOR REFERENCE at an iron rod with cap found for the northwest corner of
said Lot 2, same being the northeast corner of Lot 1, of said EMIIVLC Subdivision, same being
on the south right-of-way line of Hidden Acres Drive (50 foot right-of-way width);
THENCE with the west line of said Lot 2, same being the east line of said Lot 1, S 03° 01' 00" E

easement, N 86° 56' 57" E for a distance of 10.17 feet to the west line of an existing building, for
the northwest corner and POINT OF BEGINNING hereof;
THENCE continuing through the interior of said Lot 2, the following four (4) courses and
distances:
1) with the north line of said 15 -foot wide wastewater easement, N 86° 56' 57" E for a
distance of 15.21 feet to the east line of said building, for the northeast corner hereof,

Re: Proposed release of (2) approximate 2.4' x 15' portions of a waste water easement
Dear City Manager:
The purpose of this request is to release the above described easement or portion thereof to
exclude the southern portions of Assured Self Storage buildings "G" and "1", located at 1515
N. AW Grimes Blvd., due to incidental encroachment on the existing waste water easement
at the time of construction.
This is not a public utility easement, but only a waste water easement dedicated to the city of
Round Rock, therefore no other utility service's approval is required.
