On September 7-8, 2010, Brushy Creek experienced extraordinary flooding conditions, causing the
creek level to swell out of its banks and inundate a portion of the Brushy Creek Regional
Wastewater System (BCRWWS) West WastewaterTreatment Plant. Since that time, the facility has
been shut down and the wastewater flow has been diverted to the BCRWWS East Wastewater
Treatment Plant.
This project has repaired the damages experienced from the flooding as well as moved equipment
that was previously located in the floodplain to a higher elevation. In addition, under a renewed
wastewater permit (TPDES NO. W00010264001) issued September 28, 2009, the plant as of
September 28, 2012 must achieve all of its plant effluent discharge parameters including an
additional 17.4 mg/I daily average for nitrate nitrogen. The improvements constructed during this
project have ensured that the plant can meet these requirements. The Cities of Cedar Park, Austin
and Round Rock have paid for this project based on their allocated capacity in the treatment system.
Round Rock's percentage of capacity is 81.96%.
On June 9, 2011, DCS Engineering, LLC was contracted to design rehabilitation improvements to
the West Wastewater Treatment Plant and submit a renewal of the wastewater permit to Texas
Commission on Environmental Quality. Along with plant effluent discharge parameters requirements,
the permit requires a Nuisance Odor Prevention Plan be submitted as set forth in the issued Texas
Pollutant Discharge Elimination System permit. The cost to prepare the Nuisance Odor Prevention
Plan is $14,250, and since Round Rock's capacity is 81.96%, the cost to the City will be $ 11,679.30.
Staff recommends approval.

This Supplemental Contract No. 1 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and DCS Engineering, LLC,
hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 9th day of June, 2011 for the BCRWWS West Wastewater
Treatment Plant Rehabilitation Project in the amount of $547,011.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $14,250.00 to a total of $561,261.00;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 1, City Services and Exhibit A, City Services shall be amended as set forth in the
attached Addendum To Exhibit A.
If.
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$14,250.00 the lump sum amount payable under the Contract for a total of $561,261.00, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Contract in duplicate.

ADDENDUM TO EXHIBIT A
City Services
The City of Round Rock (City) shall furnish to the Engineer the following items, information, and
assistance:
1. Provide access to and make provisions for Engineer and his subconsultants to enter property as
required for Engineer to perform the services under this contract.
2. Assist Engineer in visiting the site as needed to finalize plan.
3. Provide timely review of plan so as not to delay the services of the Engineer.
4. Designate a person to act as the Owner's representative with respect to services to be rendered
under this contract. Such person shall have complete authority to transmit instructions, receive
information, and interpret and define Owner's policies and decisions.
5. Furnish approvals and/or permits from all governmental authorities having jurisdiction over the
project as required for completion of the project. Pay all fees associated with approvals and
permits including any TCEQ fees.
ADDENDUM TO EXHIBIT B
Engineering Services
1.0 NUISANCE ODOR PREVENTION PLAN
Per your request, we are proposing to provide professional engineering services for the Brushy Creek
West Regional Wastewater Treatment Facility nuisance odor prevention plan for the Texas Commission
on Environmental Quality (TCEQ) to meet the requirements set forth in the issued Texas Pollutant
Discharge Elimination System (TPDES) permit. The plan will be prepared and submitted to TCEQ on
behalf of the City of Round Rock for the permitted treatment capacity of 3.0 mgd average annual flow. It
should be noted here that the deadline to submit the plan is March 30, 2014. The scope of work for
preparing a TCEQ nuisance odor prevention plan includes the below items:
1. Provide a nuisance odor prevention plan in accordance with 30 TAC § 309.13(e)(2). Within 60 days
of permit issuance. Submittal for the nuisance odor prevention request for approval by the Executive
Director in care of the TCEQ Wastewater Permitting Section (MC 148).
2. The request for nuisance odor prevention shall be in the form of an engineering report, prepared and
sealed by a licensed professional engineer, in support of the request according to the requirements of
30 TAC § 309.13(e)(2).
3. The engineering report shall address:
• Existing climatological conditions such as wind velocity and atmospheric stability
• Surrounding land use which exists or which is anticipated in the future
• Wastewater characteristics in affected units pertaining to the area of the buffer zone
• Potential odor generating units
• Proposed solutions to prevent nuisance conditions at the edge of the buffer zone and beyond.
4. Proposed solutions shall be supported by actual test data or calculations.
5. The request shall be submitted to the executive director for approval after the permitting process is
completed in accordance with the issued permit.
6. Produce exhibits to support concepts, solutions, graphically present data, or present existing
conditions at the facility.
7. Coordinate with TCEQ regarding data submission requirements for the plan.
8. Confirm and refine, with Owners assistance, key parameters including land use and buffer zone.
9. Assemble Application package, obtain Owner's signature, and submit four copies to the TCEQ.
10. Provide four copies of the report to the City.
11. Respond to questions from TCEQ staff during the review process.
12. Fees required by public agencies including TCEQ will be paid directly by the City of Round Rock.
ADDENDUM TO EXHIBIT C
Work Schedule
The timeline is based on receiving a notice to proceed by March 14, 2014. Preparation and submittal of
the plan will be completed by March 30, 2014. We anticipate TCEQ will require approximately 2.5
months to review and approve the proposed plan. DCS's total work effort is anticipated to be
completed within three months, by June 14, 2014.
One deliverable will be produced: a nuisance odor prevention plan addressing treatment plant items
which do not meet the 150 ft buffer zone requirements including: the influent lift station, treatment unit
No.'s aeration basin and clarifier, and headworks building. The majority of the effort for this project
will be performed within the first two weeks of the project.
ADDENDUM TO EXHIBIT D
Fee Schedule
Our proposed fees for the above detailed scope of work are provided on a lump sum fee basis as noted in
the below table. The above referenced services will be performed within the duration discussed in
Exhibit C. DCS's liability to the Client for any cause or combination of causes is in the aggregate
limited to an amount no greater than the fee earned under this agreement.

DCS will invoice monthly for services rendered the preceding month based on the percentage of services
completed or hours expended per project task. In addition, certain out-of-pocket expenses, including
plotting and reproduction, deliveries, automobile mileage, equipment rental, and travel expenses are
included in the above fee schedule. Client shall pay DCS within 30 days for the services rendered and
invoiced.
