Section 36-46 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by an approved plat or by separate instrument. The purpose of the vacation of the easement is to allow the homeowner additional area to allow adequate space for a deck. Utilities has consented to the proposed vacation. Staff recommends approval.
