O-91-2543 - 8/8/1991ORDINANCE NO. � 5 43 AN ORDINANCE AMENDING SECTION 9.502, CODE OF ORDINANCES, 1990 EDITION, CITY OF ROUND ROCK, TEXAS; MAKING CERTAIN ADDITIONS AND/OR DELETIONS TO SAID SECTION; THEREBY DECLARING THE MAXIMUM PRIMA FACIE SPEED LIMITS UPON IH -35 FRONTAGE ROADS WITHIN THE CORPORATE LIMITS OF THE CITY OF ROUND ROCK, TEXAS, PURSUANT TO AND IN ACCORDANCE WITH THE PROVISIONS OF THE "UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS' (VERNON'S ANN. CIV. STAT. ART. 6701D); AND PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. Based upon an engineering and traffic investigation and pursuant to and in accordance with, the provisions of the "Uniform Act Regulating Traffic on Highways" (Vernon's Annotated Civil Statutes, article 6701d), the City Council hereby determines and declares that except when a special hazard exists that requires lower speeds in order to avoid colliding with any person, vehicle or other conveyance on or entering a street or highway, the limits, specified in this Ordinance shall be lawful, but any speed in excess of the limits specified to this Ordinance shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful. II. That Section 9.502(8), Code of Ordinances, 1990 Edition, City of Round Rock, Texas, (The maximum prima facie speed limit shall be fifty (50) miles per hour along the following streets:) is hereby amended by adding the following: ON FROM TO East Frontage Road Milepoint 0.516 Milepoint 3.279 of IH -35 West Frontage Road Milepoint 3.217 Milepoint 0.259 of IH -35 OR07251E That Section 9.502(9), Code of Ordinances, 1990 Edition, City of Round Rock, Texas, (The maximum prima facie speed limit shall be fifty-five (55) miles per hour along the following streets:) is hereby amended by deleting the following: ON East Frontage Road of IH -35 West Frontage Road of IH -35 FROM Milepoint 3.279 North City Limits of City of Round Rock at Milepoint 6.876 IV. TO North City Limits of City of Round Rock at Milepoint 6.876 Milepoint 3.279 That Section 9.502(9), Code of Ordinances, 1990 Edition, City of Round Rock, Texas, (The maximum prima facie speed limit shall be fifty-fivey (55) miles per hour along the following streets:) is hereby amended by adding the following: ON FROM TO East Frontage Road of IH -35 West Frontage Road of IH -35 East Frontage Road of IH -35 West Frontage Road of IH -35 South City Limit at Milepoint 2.845 North City Limit at Milepoint 6.876 Milepoint 3.279 Milepoint 0.259 V. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2. Alternative 1.. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. Consider an ordinance amending the Traffic Code by establishing new speed limits on the IH -35 frontage road system. (Second Reading) STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: Approval The revised speed zones (along the IH -35 frontage road) contained in this proposed ordinance have been recommended by the State Department of Highways and Public Transportation. These recommendations are in turn based on a recent traffic engineering study conducted by that department.
