AN ORDINANCE ORDERING THE DEMOLITION OF A CERTAIN BUILDING OR
STRUCTURE LOCATED AT 109 WEST AUSTIN AVENUE, ROUND ROCK,
TEXAS, IN ACCORDANCE WITH CHAPTER 3, SECTION 3.300, UNSAFE
BUILDING ABATEMENT CODE, CODE OF ORDINANCES, 1990 EDITION,
CITY OF ROUND ROCK, TEXAS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
I.
That a Public Hearing was held on October 11, 1990, in accordance
with the provisions of Chapter 3, Section 3.300, Unsafe Building
Abatement Code, Code of Ordinances, 1990 Edition, City of Round Rock,
Texas, to determine whether or not a certain structure or structures
located at 109 West Austin Avenue, Round Rock, Texas, are unsafe under
the provisions of said Code.
II.
That the City Council upon consideration of the testimony and
exhibits received in evidence has found that the structure located at
the above-described address is unsafe for the following reasons:
A. The building or structure is manifestly unsafe or unsanitary
for the purpose for which it is being used.
B. The building, structure or portion thereof, as a result of
decay, deterioration or dilapidation is likely to fully or
partially collapse.
C. The building, structure or portion thereof is in such a
condition as to constitute a public nuisance.
D. The building, structure or portion thereof is:
1. unsafe or unsanitary;
2. constitutes a fire hazard;
3. dangerous to human life, in relation to existing use, and
constitutes a hazard to safety or health by reason of
inadequate maintenance, dilapidation, obsolescence or
abandonment.

It is hereby ordered that the structure or structures located at
the above-described location be demolished within thirty days after the
final passage of this Ordinance.
IV.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this ordinance
shall not invalidate other sections or provisions thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative vote
of all the Council members present, the requirement for reading this
ordinance on two separate days was dispensed with.

As per your request, these are the findings and opinion relating to the struc-
tural condition of the above referenced residence. This residence is a one
story wood framed three room structure with a wood floor framing system sup-
ported on rocks. The residence is more than 60 years old. The inspection
took place on November 16, 1990, the purpose of which was to determine if
there are any structural deficiencies. The following are my findings:
1) The roof structure at the rear of the structure over the bathroom and
bedroom area has sustained fire damage and will need to be replaced.
2) The roof joist over the front room appears to be in adequate shape,
however, access to view all areas of the structure was very limited. Be-
cause of the age of the residence this area will need to be completely
inspected to check for rotted and deteriorated members and those re-
placed.
3) The roof decking for the entire structure will need to be replaced to
bring within the allowable spans for the existing building codes.
4) The walls of the structure appear to have a very minimum of wall studs
and do not appear to be adequate to meet existing building codes. The
addition of wall studs will bring the walls up to code. Because of the
age of the residence this area will need to be completely inspected to
check for rotted and deteriorated members and those replaced.
5) The floor system appears to be in a weakened state as it has excessive
deflections is some areas with a person loading that area. The worst
area where this was noted is at the rear entry door. The floor system is
supported directly on large stones or rock and within 4-6 inches of the
ground. The exterior wall siding is within 3-4 inches of the ground. Be-

cause of the age of the residence and its close proximity to the ground
surface this area will need to be completely inspected to check for
rotted and deteriorated members and those replaced.
6) The entire structure is leaning toward the east. This may be from inade-
quate lateral bracing or from foundation movements. Further investiga-
tion will be required to determine the cause and the necessary correc-
tive measures.
The structure of this residence appears to be in a state of deterioration and
will require considerable upgrading to bring it to an occupiable state. There
are also several areas where the structure does not meet the current Southern
Building Code. These areas are:
1) Section 1703.7 requires that the siding be more than 6 inches above the
ground surface or be pressure treated wood. The exterior wall siding is
extended to within 3-4 inches of the ground.
2) Section 1703.2 requires that wood joist within 18 inches or wood girder
within 12 inches of the ground be pressure treated wood. The floor sys-
tem is no more than 4-6 inches above the ground.
3) Chapter 19 for Rodent -Proof construction requires the exterior walls to
extend to the ground and be constructed of masonry or metal. The wood
siding existing on the residence is not acceptable.
4) Section 1302.5 requires the crawl space below floors to be ventilated.
There is no noted vents in this area.
5) Section 1703.8.1 requires a minimum of one access opening not less than
18 x 24 inches. There is on such access at this residence.
Generally the residence will require substantial renovation to bring it up to
code. This work may not be economically feasibly as it may be cheaper to raze
the existing structure and rebuild a new one of the same square footage. Other
items to consider in the decision are the need to bring the electrical service
and plumbing up to code.
This report is based on a visual survey of the structure and only documents
the problems at this time only. The problems associated with this building are
dynamic in nature and therefore no warranties are implied as to future perfor-
mance. No attempt was made to make any analytical determination of stress
levels in any members. Similarly no exhaustive investigation in all code viola-
tions was made. Therefore Fisher, Hagood & Hejl cannot be held liable or
responsible for any future problems or performance related to the design of
the structural members or code.

Dear Round Rock City Councilmembers:
As a businessman, I am concerned about the area around my
establishment, I have been at this location for a number of years
and have made many improvements during that time to enhance
my locality.
I am writing relating to the structure at 107 West Anderson
Avenue. There is a point in which a structure outlives its
usefulness. This is one of those structures. When the wooden shell
of a building is no longer sound and insects and rodents are
harbored there, the health and safety of the neighborhood is
brought into question.
In years past, this area has not been properly maintained by the
owners. The tenants were good people, but the owners failed to
keep this structure in livable shape. The fire in October of 1989 has
left only a skeleton of a building. Leaving this eyesore would be
asking for future health and safety problems.
Please vote to clean up this neighborhood and remove this
hazardous structure as soon as possible.

This letter is being written out of a concern about the condition of a house
located at the northeast corner of Blair and Austin Streets. Last year this
house was destroyed by fire. The ruins of the house have created a safety con-
cern for our neighborhood. Of greater significance, in recent weeks, some of
the students at our school have been observed before and after school hours at
the house participating in deviant behavior, such as smoking. Our school offi-
cials will attempt to monitor this situation and deal with the students who are
trespassing. This is something that we will try to do to help alleviate an
undesirable condition. More importantly however, a critical safety hazard
exists at that location. I am afraid that one or more of our students may be
seriously injured while messing around that property. Can anything be done to
get the property torn down and removed from the premises?
If we can be of any assistance to the city in this matter, please do not
hesitate to contact me.
