AN ORDINANCE AMENDING SECTION 2.304, CODE OF ORDINANCES, 1990
EDITION, CITY OF ROUND ROCK, TEXAS BY AMENDING SUB -SECTION (1)
CONCERNING THE IMPOUNDMENT AND SALE OF DOGS; PROVIDING FOR A
SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
I.
That Section 2.304(1), Code of Ordinances, 1990 Edition, City of
Round Rock, Texas is hereby amended to read as follows:
(1) Dogs to be Impounded and Sold
Any dog placed in the city pound in accordance with the
provisions of this section shall be kept and so impounded for
a period of seventy-two (72) hours, unless earlier redeemed by
the owner. At the expiration of the said seventy-two (72)
hour period, the city shall become the owner of the dog and
the animal warden may sell the dog for cash in the amount
sufficient to pay all impoundment fees or cause the dog to be
destroyed. If the impounded dog has been tagged and licensed
in accordance with subsection 2.302 (1) and (3), the animal
warden may not sell or destroy the dog for a period seven (7)
days after impoundment. The owner or keeper of the dog may at
any time before the dog is sold or destroyed pay the fees
provided for in subsection 2.303(5) of this section and
receive the dog from the city pound or wherever said dog shall
be impounded. Any person who shall pay the amount of the fees
due for impounding and keeping any dog shall have such dog
delivered to him at the city pound upon payment to the animal
warden of the amount due, and the person shall be entitled to
have the dog registered in his or her name and receive a tag
therefor by presenting to the animal warden a certificate from
a practicing veterinarian stating that the dog has been
vaccinated against rabies and the payment of the license fee.
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this ordinance
shall not invalidate other sections or provisions thereof.

ITEM: 11.I. Consider an ordinance amending the Animal Control
Ordinance. (First Reading)

STAFF RECOMMENDATION:
At the next meeting of the City Council, Public Works will
propose amending the Animal Control Ordinance to reflect altering
the time in which the City must impound a dog. Currently, a dog
must be kept for seven days prior to euthanasia. The proposal
would allow the animal to be destroyed after 72 hours if the dog
is not properly licensed and displaying such license. If a
properly licensed animal is picked up, it will remain impounded a
minimum of seven days and its owner will be contacted if possible.
The reason for this immediate change is the lack of space in
our facility. The facility can only hold 19 animals according to
the Health Department criteria. It is often overcrowded and this
change is necessary for relief. After the first of the year we
will return with:

etc.
