O-90-2494 - 8/9/1990ORDINANCE NO. � q q 4 AN ORDINANCE AMENDING CHAPTER 1, SECTION 1.805(2), CODE OF ORDINANCES, 1990 EDITION, CITY OF ROUND ROCK, TEXAS; PROVIDING THAT THE PROHIBITION AGAINST ALCOHOLIC BEVERAGES IN CITY OWNED SWIMMING POOL AREAS SHALL NOT APPLY TO POOLS OPERATED BY A THIRD PARTY; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 1, Section 1.805(2), Code of Ordinances, 1990 Edition, City of Round Rock, Texas is hereby amended to read as follows: (2) Swimming Pool Areas Except as provided herein, it shall be unlawful for any person, firm, or corporation to carry, possess, or drink any alcoholic or intoxicating beverage in any City owned and operated swimming pool area. The foregoing prohibition shall not apply to any swimming pool owned by the City, but operated or managed by a third party under contract with the City. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. Consider an ordinance amending the City Code concerning unlawful drinking or possession of intoxicating beverages within certain areas. (Second Reading) STAFF RESOURCE PERSON: SHARON PRETE STAFF RECOMMENDATIONS: Presently City Code prohibit the sale, possession or consumption of alcoholic beverages in City owned and operated swimming pool areas. Since we do not want to inhibit Golf Corps' ability to sell alcoholic beverages at Forest Creek Golf Club, staff recommend that the ordinance be changed to accomodate a third party operator.
