AN ORDINANCE AMENDING CHAPTER 1, SECTION 1.803, CODE OF
ORDINANCES, 1990 EDITION, CITY OF ROUND ROCK, TEXAS BY
PROVIDING AN EXCEPTION FOR REQUIRED SEPARATION OF THE SALE OF
ALCOHOLIC BEVERAGES FROM CHURCHES, SCHOOLS, AND HOSPITALS;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
ORDINANCES AND RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
I.
That Chapter 1, Section 1.803(4), Code of Ordinances, 1990 Edition,
City of Round Rock, Texas is hereby amended to read as follows:
(4) Except as provided in paragraph (5) below, the sale of
alcoholic beverages within three hundred (300) feet of a
church, public school, or public hospital, as determined by
measurements prescribed in this section, is prohibited.
II.
That Chapter 1, Section 1.803, Code of Ordinances, 1990 Edition,
City of Round, Texas is hereby amended by adding a paragraph (5) which
shall read as follows:
(5) Where the church, public school, or public hospital is located
within a commercial zoning district, no separation from places
of business where alcoholic beverages are sold shall be
required.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this ordinance
shall not invalidate other sections or provisions thereof.

of all the Council members present, the requirement for reading this
ordinance on two separate days was dispensed with. til

ITEM: 8C. Consider an ordinance amending the City Code relating to the
separation of certain land uses concerning sale and consumption
of alcoholic beverages. (First Reading)

As discussed previously, this ordinance will eliminate a conflict which has arisen
between uses allowed in commercial zones.
Chapter 1 Section 8.0 of the City Code of Ordinances restricts the sale of alcoholic
beverages within 300 feet of a church, public school or public hospital. This has
resulted in minimal conflicts to date. However, the development of "store front
churches" in the downtown area and in shopping centers could severely restrict
businesses which sell alcoholic beverages in the only zone which permits these
uses.
This ordinance would exempt businesses from this restriction I1 the church, school
or hospital which would trigger the restriction is located in a Commercial zone.
The restriction remains in force in all other instances.
Economic Impact: The adoption of the ordinance will require a minimal amount of
additional staff review.
