R -03-12-18-8E2 WHEREAS, the City of Round Rock has previously entered into an Agreement for Engineering Services ("Agreement") with Huggins/Seiler & Associates, L.P. for planning, preliminary design, plan preparations, traffic simulation/modeling and other associated tasks and services, and WHEREAS, Huggins/Seiler & Associates, L.P. has submitted Supplemental Agreement No. 1 to the Agreement to extend the contract date, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 to the Agreement with Huggins/Seiler & Associates, L.P., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Agreement with Huggins/Seiler & Associates, L.P., a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHEREAS, the City and Engineer executed an Agreement for Engineering Services, hereinafter called the "Agreement," on the 19th of December 2002 to retain engineering services for planning, preliminary design, plan preparations, traffic simulation/modeling and other associated tasks and services, and WHEREAS, Article 3, Contract Term, requires the termination of the Agreement on December 19th, 2003 unless the Agreement is extended, and WHEREAS, it has become necessary to amend the Agreement to extend the termination date, NOW THEREFORE, premises considered, the City and the Engineer agree that said Agreement is amended as follows: Article 3, Contract Term, shall be amended to extend the Agreement period to December 31, 2004. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 1 to the Agreement for Engineering Services with Huggins/Seiler & Associates, L.P. for planning, preliminary design, plan preparations, traffic simulation/modeling and other associated tasks and services. In order to respond quickly to capacity and citizen concerns, staff desires to create an expedited engineering process and supplement City staff during heavy demand periods.
