R -04-02-12-14C8 WHEREAS, the City of Round Rock desires to retain professional appraisal services regarding the acquisition of right-of-way for the proposed Avery Farms Wastewater Interceptor Transmission Line, and WHEREAS, Paul Hornsby & Company has submitted an engagement letter to provide said services, and WHEREAS, the City Council desires to enter into said engagement letter with Paul Hornsby & Company, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an engagement .letter with Paul Hornsby & Company for appraisal services regarding the acquisition of right-of-way for proposed Avery Farms Wastewater Interceptor Transmission Line, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as. required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Dear Mayor Maxwell: At your request, I am pleased to provide this proposal for appraisal services on the above - captioned property. Terms of the assignment are summarized below. Real Estate to be Appraised: 1) Whole Property (Parcel 1 - Meadows at Chandler Creek): Approximately 13.23 acres of land located along the southeast line of Old Settler's Blvd., just west of FM 1460. Part To Be Acquired: A 0.772 acre, f20' wide wastewater line easement located along the eastern boundary and south-central portion of the whole property. Remainder: Approximately 13.23 acres of land, subject to the above -referenced easement. 2) Whole Property (Parcel 2 - Martin): Approximately 93.74 acres of land improved with a single family residence and ancillary ranch structures located at the northwest corner of Old Settler's Blvd. and FM 1460. Part To Be Acquired: A 0.47 acre, ±20' wide wastewater line easement traversing the far southeast portion of the whole property. Use of the Report: To assist the client in negotiations involving the acquisition of easements for the extension of wastewater lines. Appraisal & Reporting Standards: The appraisals will be developed and the reports will be prepared in conformity with and subject to the requirements of the Uniform Standards of Professional Appraisal Practice (USPAP) of the Appraisal Foundation and the Code of Professional Ethics and Standards of Professional Appraisal Practice of the Appraisal Institute. We will undertake complete appraisals, the results of which will be set forth in summary appraisal reports as defined by Standard Rule 2.2(b) of USPAP. Fee: Parcel 1 - Meadows at Chandler Creek: $3,750 Parcel 3 - Wallin: $3.750 Total $7,500 The fee for each appraisal is payable upon completion of the respective assignment. The fee reflects a 2 -parcel assignment and is contingent on both appraisals being undertaken concurrently. The quoted fees assume appraisal of land only. Should improvements need to be appraised, the fee would be raised to a mutually agreed m nount.
