R -04-02-26-8E1 WHEREAS, the City of Round Rock has previously entered into an Agreement for Personal Services for Project Administration and Inspection for 2002 CIP Tank Rehabilitation Project with John H. Konzen, and WHEREAS, John H. Konzen has submitted Supplemental Agreement No. 2 to the Agreement to extend the contract period, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 2 with John H. Konzen, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 2 to the Agreement for Personal Services for Project Administration and Inspection for 2002 CIP Tank Rehabilitation Project with John H. Konzen, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. KONZEN" THE STATE OF TEXAS § § KNOW ALL BY THESE PRESENTS: COUNTY OF WILLIAMSON § That this Supplemental Agreement No. 2 to "Agreement for Personal Services for Project Administration and Inspection for 2002 CIP Tank Rehabilitation Project with John H. Konen" is made by and between the City of Round Rock, with offices located at 221 East Main Street, Round Rock, Texas, 78664 (hereinafter referred to as the "City") and John H. Konen, with offices located at Post Office Box 1208, Round Rock, Texas, 78680 (hereinafter referred to as "Konen"). WHEREAS, the City and Konzen executed "Agreement for Personal Services for Project Administration and Inspection for 2002 CIP Tank Rehabilitation Project with John H. Konen" (hereinafter referred to as the "Agreement"), on the 26th day of September, 2002, for consulting, construction administration and management, and inspection of the 500 MG Lake Creek Tank, 750 MG Chandler Creek Tank, 750 MG McNeil Tank, 1 MMG WTP Clearwell, 2MMG WTP Clearwell and 2.5 MMG S.E. Booster Tank Rehabilitation Project; and WHEREAS, the City and Konen executed "Supplemental Agreement No. 1" to said Agreement on the 28th day of August, 2003, which provided for a change in the lump sum fee to a total of $130,221.00 and an extension of the contract period through March 26, 2004; and WHEREAS, due to the fact that additional time for quality control inspection services was necessitated by the contractor's delay in completing the McNeil Ground and the Southeast Elevated Projects, it has become necessary to again amend the Agreement to provide for an extension of the contract period through December 20, 2005. NOW, THEREFORE, premises considered, the City and Konen hereby agree that said Agreement is amended as follows: I. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 2 to the Agreement for Personal Services for Project Administration and Inspection with John H. Konzen for the 2002 CIP Tank Rehabilitation Project. Department: Water and Wastewater Utilities Staff Person: Tom Clark, Director of Utilities Justification: An extension of John H. Konzen's contract period is required to complete this project. Rehabilitation Project schedule was extended due to operational limitations in our water distribution system. These limitations were corrected with the construction of the Southeast 16" Waterline By-pass Improvements. With the completion of the Southeast 16" Waterline By-pass we will now be able to isolate the Southeast Ground Tank, while maintaining adequate service to the Southeast part of town via the Southeast 16" Waterline By-pass. Funding: Cost: N/A Source of funds: Capital Project Funds (Self -Financed Utility) Outside Resources: John H. Konzen Background Information: The general scope of work under this contract amendment will include general project administration, construction management and inspection for each of the two (2) remaining tanks to be rehabilitated under 2002- 2003 CIP Tank Rehabilitation Project, which include a total of six (6) tanks. This amendment is only necessary to extend the contract period.
