We, the undersigned officers of said City, hereby certify
as follows:
1. The City Council of said City convened in REGULAR
FETING ON THE 10THDAY OF AUGUST, 1978, at the City Hall, and
he roll was called of the duly constituted officers and members
f said City Council, to -wit:

and all of said persons were present, except the following

OF INTENTION :TO ISSUE CERTIFICATES OF OBLIGATION
was duly introduced for the consideration of said City Council
and read in full. It was then duly moved and seconded that
said Ordinance be passed; and, after due discussion, said
motion, carrying with it the passage of said Ordinance, pre-
vailed and carried by the following vote:

2. That a true, full and correct copy of the aforesaid
Ordinance passed.at the Meeting described in the above and
foregoing paragraph is attached to and follows this Certificate;
that said Ordinance has been duly recorded in said City Council
minutes of said Meeting; that the above and foregoing paragraph
is a true, full and correct excerpt from said City Council's
minutes of said Meeting pertaining to the passage of said
Ordinance; that the persons named in the above and foregoing
paragraph are the duly chosen, qualified and acting officers
and members of said City Council as indicated therein; that
each of the officers and members of said City Council was duly
and sufficiently notified officially and personally, in advance,
of the time, place and purpose of the aforesaid Meeting, and
that said Ordinance would be introduced and considered for
Passage at said Meeting, and each of said officers and members
consented, in advance, to the holding of said Meeting for such
Purpose; and that said Meeting was open to the public, and
Public notice of the time, place and purpose of said meeting
was given, all as required by Vernon's Ann. Civ. St. Article
6252-17.

DIRECTRING PUBLICATION OF NOTICE TO BIDDERS AND
GIVING NOTICE OF INTENTION TO ISSUE CERTIFICATES
OF OBLIGATION

CITY OF ROUND ROCK
WHEREAS, the City Council finds that an improvement program
is urgently needed by the City of Round Rock, Texas, for im-
provements and extensions to the City's Waterworks System, to -
wit: to construct, improve and equip wells, lines, pumps, ground
storage reservoirs and facilities for which it is necessary to
advertise for bids to construct such improvements; and
WHEREAS, the City deems it advisable to seek bids to im-
prove and extend the City's Waterworks System, to -wit: to con-
struct, improve and equip wells, lines, pumps, ground storage
reservoirs and facilities, and to give notice of intention to
issue $300,000 of Certificates of Obligation, payable from ad
valorem taxes, and a junior lien on the net revenues of the
City's Waterworks System that will be sold for cash to pay, in
whole or in part, the contract price of the construction for
this project, and to pay legal, fiscal and engineering fees in
connection with this project; and
WHEREAS, it is hereby officially found and determined that
a case of emergency or urgent public necessity exists which
requires the holding of the meeting at which this Ordinance
is passed, such emergency or urgent public necessity being that
the advertisement to bidders and notice of intention to issue
certificates of obligation should be published as soon as
possible and without delay for necessary and urgently needed
public improvements; and that said meeting was open to the
public and public notice of the time, place, and purpose of
said meeting was given, all as required by Art. 6252-17,
V.A.T.C.S.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ROUND ROCK, TEXAS:
1. That attached hereto is a form of the Notice to Bidders
land Notice of Intention to Issue Certificates of Obligation,
I the form and substance of which is hereby adopted and approved.
2. That the City Secretary shall cause said Notice to be
published in substantially the form attached hereto, in a news-
apper of general circulation in the City of Round Rock, and
published in the city, on the same day in each of two consecu-
tive weeks, the date of the first publication thereof to be at
least 14 days prior to the time set for receiving bids as shown
in said notice.
3. That this Ordinance was read once by the City Council
and it was deemed by said City Council that upon passage of the
Ordinance it shall take effect immediately.
NOTICE TO BIDDERS
AND NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION
Sealed bids, in envelopes, addressed to City Council of Round
Rock, Texas, will be received at City Hall 214 East Main Street,
Round Rock, Texas 78664 until 10:00 p.m., August 31, 1978, and
then publicly opened and read, for furnishing all plant, labor,
material and equipment and performing all work required for the
construction of water system improvements located in Round Rock,
Williamson County, Texas. -
9 ids will be submitted in sealed envelopes for each project on
the proposal furnished, and marked in the upper left hand corner,
"Bid for Water System Improvements - 1978, to be opened at 10:00
P; -m., August 31, 1978. "
All proposals shall be accompanied by a cashier's certified check
upon a national or state bank in the amount of five (5) percent
of the total maximum bid price payable without recourse to City
oi Round Rock, Texas, or a bid bond in the same amount from a
reliable surety company, as a guarantee that bidder will enter
into a contract and execute performance bond within ten (10) days
akter notice of award of contract to him. The notice of award of
c6ntract shall be given by the Owner within thirty (30) days. The
bid security must be enclosed in the same envelope with the bid.
Bids without check or bid bond will not be considered.
Ail bid securities will be returned to the respective bidders
within thirty (30) days after bids are opened, except those which
the Owner elects to hold until the successful bidder has executed
the contract. Thereafter all remaining securities, including
st curity of the successful bidder, will be returned within thirty
(,0) days.
The successful bidder must furnish a performance bond and payment
bind upon the forms which are available in the office of Owner
it the amount of one hundred (100%) percent of the contract price
fom an approved surety company holding a permit from the State
o Texas to act as surety (and acceptable according to the latest
list of companies holding certificates of authority from the
Sil
ecretary of the Treasury of the United States) or other surety
or sureties acceptable to the Owner, with approval prior to bid
opening.
The right is reserved, as the interest of the Owner may require,
to reject any and all bids, and to waive any informality in bids
received.

Prequalification Requirements: The low bidder may be requested
to submit information regarding his qualifications in accordance
with instructions contained in -the Bid Form.
The improvements shall be completed within the number of days
as filled in by the Contractor in the Proposal after the notice
to proceed from the Owner.
