WHEREAS, the City of Round Rock entered into a contract on January 26, 2012 with Chasco
Constructors, Ltd., L.L.P., entitled "Agreement Between Owner and Construction Manager at Risk
Where Construction Manager at Risk Is Also the Constructor," and such contract is for new construction
of a Sports Complex at 2400 Chisholm Trail, and
WHEREAS, the terms of such contract require submission by Chasco Constructors, Ltd., L.L.P.
of "Amendment No. 1 to Agreement Between Owner and Construction Manager at Risk," which
Amendment No. 1 is to set forth the Guaranteed Maximum Price as required in the contract, and
WHEREAS, the City Council wishes to accept such Amendment No. 1 to the referenced
Agreement, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute, on behalf of the City, Amendment
No. 1 with Chasco Constructors, Ltd., L.L.P. for the Guaranteed Maximum Price as stated therein, and
same is for new construction of a Sports Complex at 2400 Chisholm Trail, a copy of said Amendment
No. 1 being attached hereto as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and subject
of the meeting at which this Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and the subject matter hereof were
discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551,
Texas Government Code, as amended.

AMENDMENT NO. 1 TO AGREEMENT BETWEEN
OWNER AND CONSTRUCTION MANAGER AT RISK
Pursuant to Article 2, Subparagraph 2.7 of the previously -executed "Agreement Between Owner
and Construction Manager at Risk Where Construction Manager at Risk is Also the Constructor ( the
Agreement), dated the 26th day of the month of January, 2012, by and between the City of Round Rock,
Texas (the Owner) and Chasco Constructors, Ltd., L.L.P. (the Construction Manager), for new
construction of a Sports Complex (titled in subsequent documents as the Round Rock Sports Center) at
2400 Chisholm Trail (the Project), the Owner and the Construction Manager hereby establish a
Guaranteed Maximum Price, and reiterate the scope of the Project and Completion Date for the Work as
contained in the Agreement and as set forth below.
Article 1
THE WORK
The scope of the Project included in this Amendment, and its Guaranteed Maximum Price, is for
the work in its entirety for the construction of the above -referenced Project.
Article 2
EXHIBITS
The following exhibit supplements this Agreement:
Exhibit "A" Section 1 "Description of Work": prefaced by a Document List, and including
Clarifications, Assumptions, and Qualifications; and additionally including
Exclusions.
Section 2 "Cost Summary": including Guaranteed Maximum Price, inclusive of
the Construction Manager's contingency and all design, and also including
Alternates; and additionally including Cost Breakdown.
Article 3
GUARANTEED MAXIMUM PRICE
The Construction Manager's Guaranteed Maximum Price (the GMP) for the Work, including the
estimated Cost of the Work as defined in Article 6 and the Construction Manager's Fee as defined in
Article 5, is the sum of FOURTEEN MILLION FIVE HUNDRED TWENTY-SEVEN THOUSAND
TWO HUNDRED NINETY-FIVE AND 00/100 DOLLARS ($14,527,295.00).
This price is for the performance of the Work in accordance with the Contract Documents and
any attached exhibits.

COMPLETION DATE
The Substantial Completion Date for the Project is three hundred sixty-five (365) calendar days
from the date the Notice to Proceed is given to the Construction Manager by the Owner.

proposing to use HDMI converters/extenders, utilizing CAT5e cabling to connect each
basketball courts pair of monitors to a PC workstation or laptop that runs a scoreboard
control/display software. This is a specific basketball scoreboard application, but templates
for other sports are available. Eight (8) operable screen hoist systems and four (4)
stationary mast systems for the visual displays are included in the Athletic Equipment
Section of this proposal

Contingency
A Construction Manager's Contingency of 10% is included in this price. This contingency is

Owner to add improvements to the project or to perform work that involves an increase in
the original scope of the project as defined by the documents. Such items added by the
Owner shall be addressed by Change Orders to the Contract. Any amount of the
Construction Manager's Contingency that remains unused by the Contractor at the
completion of the project shall be returned to the Owner in full.

5 Rainwater Collection
Storage tanks necessary to collect runoff from the roof of the new building, additional
piping required from the base building downspouts to connect to the water storage

irrigation system which is part of the base building. This work is shown on the
landscape architecture sheet and coordinated with site utilities.

AMENDMENT NO. 1 TO AGREEMENT BETWEEN
OWNER AND CONSTRUCTION MANAGER AT RISK
Pursuant to Article 2, Subparagraph 2.7 of the previously -executed "Agreement Between Owner
and Construction Manager at Risk Where Construction Manager at Risk is Also the Constructor ( the
Agreement), dated the 26th day of the month of January, 2012, by and between the City of Round Rock,
Texas (the Owner) and Chasco Constructors, Ltd., L.L.P. (the Construction Manager), for new
construction of a Sports Complex (titled in subsequent documents as the Round Rock Sports Center) at
2400 Chisholm Trail (the Project), the Owner and the Construction Manager hereby establish a
Guaranteed Maximum Price, and reiterate the scope of the Project and Completion Date for the Work as
contained in the Agreement and as set forth below.
Article 1
THE WORK
The scope of the Project included in this Amendment, and its Guaranteed Maximum Price, is for
the work in its entirety for the construction of the above -referenced Project.
Article 2
EXHIBITS
The following exhibit supplements this Agreement:
Exhibit "A" Section 1 "Description of Work": prefaced by a Document List, and including
Clarifications, Assumptions, and Qualifications; and additionally including
Exclusions.
Section 2 "Cost Summary": including Guaranteed Maximum Price, inclusive of
the Construction Manager's contingency and all design, and also including
Alternates; and additionally including Cost Breakdown.
Article 3
GUARANTEED MAXIMUM PRICE
The Construction Manager's Guaranteed Maximum Price (the GMP) for the Work, including the
estimated Cost of the Work as defined in Article 6 and the Construction Manager's Fee as defined in
Article 5, is the sum of FOURTEEN MILLION FIVE HUNDRED TWENTY-SEVEN THOUSAND
TWO HUNDRED NINETY-FIVE AND 00/100 DOLLARS ($14,527,295.00).
This price is for the performance of the Work in accordance with the Contract Documents and
any attached exhibits.
