S AN ORDINANCE AMENDING CHAPTER 46, SECTION 46-70(b), CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING AMENDING THE POWERS AND DUTIES OF THE HISTORIC PRESERVATION COMMISSION CONCERNING THE CITY'S NAMING AND RENAMING POLICY; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That Chapter 46, Section 46-70(b) Code of Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended to read as follows: Sec. 46-70. Historic preservation commission (HPC). (b) Powers and duties. The HPC shall have the following powers and duties pursuant to the provisions of applicable statutory requirements for a historic preservation commission under state law: (1) Certificate of appropriateness. The HPC shall render decisions on applications for certificates of appropriateness. (2) Historic district or landmark designation. The HPC shall recommend designation of specified areas of the city as historic districts or landmarks. (3) Partial tax exemption for historic sites. The HPC shall review applications and make recommendations for action to the city council regarding partial tax exemptions for historic sites. (4) Certified local government requirements. Under the certified local government (CLG) agreement with the state historical commission, the HPC shall administer the requirements of the CLG program as promulgated by the national park service. (5) Renaming city facilities in honor of an individual. In accordance with the city's naming and renaming policy for city facilities, park lands or streets, the HPC shall review, research, and report on requests to name or rename such facilities in honor of an individual. 265374 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
